got a notice in todays post that reckons I was clocked doing 52mph in a 30mph zone :0. Am I looking at the madetory £60 + 3 points are something much worse?

Seriously, you *may* not get asked to go to court and just get a 3 pointer and is it £60 now. If not and it is a court appearance, depending on the beak on the day and their mood anything from 3 - 6 points and a bigger fine. I am no expert but I am sure there are a few waiting to answer.

For that you are probably on the border of 3points and £60.

My mum got flashed for 65 in a 30 a while back (about 4 years ago) and got 3points and 60.

IMO she should have got more... VERY residential estate but hey ho, the camera wins every time

52 in a 30 = more than 20 mph over posted limit...rings a bell with me, sadly.

don't want to be the bearer of bad news but I got done last year on an innocent stretch of road through a forest, no schools, houses, shops and it was 11pm !!!! got done for 51 in a 30mph.

6 pts and 400 fine

needless to say I watch my speed like a hawk now...lesson learnt. Oh, I pleaded guilty by post, and had to fill in one of those earnings related forms..where they base fine on earnings so your fine could be more or less.

probably not the happy news you were hoping for....still, fingers crossed you might get off with less if your lucky.

ACPO Guidelines give the cut out rate for a Conditional Offer (60/3) at 50 mph in a 30 mph area. Over this its booked for Court hearing.

DVD, I may be wrong and may have mentioned this before, but there is definately something about the courts not being able to fine you more than the conditional offer, even though they threaten to. A colleauge of mine did this, and the beak was surprised that he knew about it.
Something aout section 6 human rites act something.............blah blah blah.
I will investigate and find out exactly what happened.

Earning related forms...if I ever had one of them I wouldn't want to fill it out. What can the courts do is you chose the right to silence. Do they just impose a high fine or look at your tax details..?

I think you highlight a myth.

Road Traffic Offenders Act, which deals with the Fixed penalty system and outlines punishments at Courts for offences, it treats speeding Conditional Offer with 60/3points and in the punishments section with 1000/3 - 6 points at Court. So we have two set punishments, different, for the same offence.

IIRC then because the punishments are set by law then Human Rights can not be invoked.
