Rear brake problem

Looking for a bit of help here guys. My Whyte has Tektro Draco brakes on it, now the rear has been having a bit of an issue. After I got the bike the rear brake went a bit spongy and when it was in for its 6-week service at the end of September it was re-bled and was back to normal again.
Now a couple of weeks ago it started getting spongy again and got that bad that the lever could be fully pulled with only minimal braking effort actually being applied. So rather than have the hassle of trailing back in to the LBS I ordered a bleed kit and cracked on. Once re-bled the lever was infinitely better (although still a marginal amount of spongy-ness remaining), however once out on the road despite the lever being back to normal there was still minimal braking effort actually slowing the bike.
After whipping the rear wheel off it was noticeable that the inside pad was slightly more worn down than the outside pad, so as the pads were original and with the odd wear I bought a replacement set of pads yesterday and fitted them up. Alas this has not solved the problem, the brake lever itself is now free of all spongy-ness however the actual braking effort on the rear is still marginal with very little braking effort actually being given (although there must be some somewhere as the disc is getting hot).
Now I had thought that perhaps there was contamination on the disc, however when I changed the pads I used some brake cleaner on the rear disc and gave it a good going over and clean with a cloth. My only thought was that with the un-even pad wear on the previous pads that the outside calliper could be sticking? or does anyone have any other thoughts on possible causes/issues? (and in an attempt to grasp at straws), if the calliper is siezed on one side is this likely to be covered under warranty for the bike given its only around 6-months old or is this likely to be a 'wear & tear' issue?
