Insurance clamping down on overblown claims?

Wifey went for petrol,realised she was at the wrong side for the filler (only had the car four years)
she pulls forward and reverses to the next pump,out of nowhere there is another car there (taxi),they touch bumpers,puts a small scratch on the plastic bumper of our car.
Other driver starts making an issue so one of the Asda staff comes over to have a look,because of the taxi drivers poor grasp of the English language the Asda woman gets the attention of another taxi driver who kindly comes over to help.
Second taxi driver translates telling first driver that there is not even a mark on his car so not to make such a big issue of nothing.
Four months go by and a letter appears from the insurance,apparently a claim has gone in for damage,injuries
and loss of earnings.Strange thing is the claim is being made through a solicitors and not an insurance company?

What I never understand in this sort of case is why, in the situations where the claim is rejected, the CPS don't pursue the claimant for fraud. Given every person who is proven to have lied in an insurance claim a criminal record and I'm sure the number of stupid claims would fall.
Couldn't agree more! Fine & criminal fine would soon have this all stamped out...I have a guy who is committing insurance fraud against me at the moment. I was parked up with the engine off and he reversed into me. He apologised profusely , saying his foot slipped off the clutch. I got my car booked in to assess the damage and got an invoice to respray the bumper. When i gave him this, he didnt want to know. I then received a letter from his insurance company saying i hit him and they want me to pay for his repairs!
Unfortunately, there were no witnesses and no cctv.
It's going to cost me my no claims bonus and £650 excess as it looks like he may be claiming for whiplash too! Scumbag.
There's so many dishonest people out there with no morals or values. Be careful out there guys!

You paid the premium, get them to work for it.

Unfortunately, they ins company have been nothing short of useless so far! I have done all the running round, trying to obtain cctv evidence, pushing and pushing after they said they couldnt get through. They seem to have resigned themselves to the fact they'll have to pay! Initially they said its a clear case of non fault and there would be no problem. You paid the premium, get them to work for it.
Then the counter claim came in and they said it'll probably be settled 50/50 , meaning they will have to pay 50% of his costs. I have said i dont want to claim on my insurance as the cost of repair isnt much (half my excess in fact!)
Useless, i dont know why i bother paying insurance!

On the flip side. I was knocked by a van whilst parked and it just caused a deep scratch on the wing (It was the ali body of the Luton van) as it was a 1mph collision!
My claims handler asked if I had whiplash which I said obviously not but he kept pushing me to claim saying it may manifest itself in a few weeks. He said I could claim for loss of earnings etc.
They're all as bad as the false claimants and I'm sure this claim culture is some what to do with the industry as a whole.

They do. There's a prog on the telly on weekday mornings that I got quite interested in during a week off. The solicitors or insurance companies hire or follow the claimants themselves and often find people out jogging or driving for miles to a camp site, thinking they're safe then throwing the cane away or taking the neck brace off.Best one was a woman claiming for injury when a bus driver had a minor bump in a bus station. Quick look on the CCTV showed her stood OUTSIDE the bus. She got costs and I think community service.

I've seen some playing football, horse riding, golf (tough round for me), celebrating a win at ascot etc. most insurence company's roll over and pay up, you as the customer need to raise hell and push it up the ladder.

I was involved in a multi car accident on the motorway a few months ago, in which two cars went into the back of me in quick succession (during which, thankfully I avoided hitting the car in front!) and other than a stiff back the day after, I was fine. I could have stuck a claim in against both drivers that hit me, but after a Friday off work sorting the paperwork and a weekend of R&R, I was 90% back to normal.
It was an accident, these things happen. If I can get away with next to no injury after that kind of an accident, it beggars belief how people can successfully claim for it after a <10mph accident (hell, after a <30mph accident if I'm being honest).
No companies hounded me for whiplash claims and I haven't seen an increase in the "We'll pay you £thegdpofasmallcountry for your whiplash claim" text messages or claims company phone calls since.

It's not just the insurance company's, it's the accident management company's that buy the info to persuade you into claiming money. The ministry of justice are to slow in dealing with these issues, and too fast to blame over zealous investigators. It's a fine line, but if we all worked together, avoided profit obsession, it wouldn't happen as much.
