I am soon handing in my notice which is 28 days according to my contract.

I also have 6 days holiday entitlement left this year.

What is the usual thing to happen here? As far as i can see, i have 2 options:

1) work for 22 days, then have a 6 day break before starting the new job.

2) work the 28 days and ask for 6 extra days payment for the holiday i am owed.

Obviously option 2 means i get more money, but frankly, Id rather take option 1.

Are these actually viable options, or is there some other protocol for these things? My contract doesn't really say anything about it.

Third option is give 34 days' notice and take the holiday for the last 6 days. Any will work (I think I've done all three).

A thought from past experience - have you accounted for your pro rata entitlement? If you are basing 6 days left on your annual entitlement, then you may be entitled to less than that if you hand your notice in having only worked part of the year.

But as we are nearing December and your holiday year is prob Jan to Dec then this is probably a moot point!

Use up the six days remaining leave in whatever way you wish between now and your employment ending. It's as simple as that!

Yeah and don't fall for the old "I'll have a word with HR, you might get paid for them if you work them, don't book anything now" or "Yeah I'm pretty certain they're given as cash if you don't use them all - we can sort all that out with your last pay"

Yes, I got caught out by that at one employer. They paid me (basic salary / 365) for the unused days. Yes, 365.

I got royally tucked up years ago, I was only part-time so rarely took any Holidays - had the equivilent of 3 weeks owed when I left, boss strongly hinted they'd be paid in cash if left unused after I left - final pay slip had nothing showing - called him up to be told "oh yeah, sorry about that got it wrong - you just lose them" whilst trying not to laugh at me.

Its a small company, so no HR department as such and nobody to pass the buck to. The person I hand the letter to will be the person dealing with final pay.

I guess i will make a point of discussing it with them after they have had time to read the letter and figure out what they want to do.

6 days isnt really that much, but with petrol prices these days its worth ensuring i get what I am contractually owed, providing i dont take the holiday, which i more than likely will.

Or take 6 days holiday and hand your notice in on your return. smile
