Yes and no, you cant see any of the white cords showing so its not right into the structure of the tyre but the small cut under the letter B will allow water into the structure of the tyre which will cause problems. I personally would replace as the tyres are the only contact with road so no chancess should be taken, you get little chips fixed in your windscreen fixed so why skimp with tyres.

My view of that would be now that part of the tyre now has no rim protection, and this fella has got previous for driving into kerbs.ETA - looking at the picture again, he's got a lot of previous for driving into kerbs.
