Hi all,

We prepare race cars for a living and are considering getting a 7.5 tonne race truck now instead of van and trailers.

I know lots of Motorsport teams run without operators licence under 'not for hire or reward'.

How does the system work?

Scenario 1: We own our race cars and customers hire them from us, do we need operators licence?

Scenario 2: We carry a customers own car to circuits, do we need an operators licence?

Or if you get stopped by VOSA do you claim that you also race the car you are carrying as if it were your own race car?

Before we go down the 7.5 tonne route it would be nice to clarify this grey area! I used to work for a well known TOCA team who were 'not for hire or reward' but carried their own car plus 2 customers cars.

Many Thanks,

Oliver

Scenario 1: Yes
Scenario 2: Yes
Or if you get stopped by VOSA do you claim that you also race the car you are carrying as if it were your own race car? : If you want to take the risk of getting caught.
You will also need tachos and abide by EU regs. If your current setup is more than 3.5 tonnes gtw you still need an O licence and tachos.
OH, I forgot, you drivers also need a drivers CPC qualification for anything over 3.5 tonnes.

You sure about the need for a CPC? That can be done using an outside consultant can't it? I'm not aware of any businesses where all the drivers have a CPC.

there is a difference between the cpc you need for a o'licence and the new requirement for a drivers CPC which is 30 odd hours of death by power point... you can even do the same course multiple times and there are no exams. pointless but now a requirement for all new drivers. existing have about a year left on grandfather rights.

if your just carrying your own goods, i.e. your cars to hire out you could go the restricted o'licence route which is simpler to get and operate which would keep you legal.

As I run my own car for me I run on a private hgv so no o licence or tacho needed.

Ah, OK. I suppose the test raises revenue?

I too run our own car and use a private 7.5T without O licence or tachometer.

We sought clarification from VOSA after getting stopped in our 7.5 vehicle. They confirmed, and we have it in writing from VOSA, that if the vehicle does not exceed 7500kgs and is used for non commercial purposes, then it is exempt from compliance with EC drivers hours, O licence requirements & fitment of tachograph equipment.

However, if you are getting paid to move customer cars, then I assume that the above will not apply (unless you can demostrate there is no financial gain on your part).
