my aunt has being pulled for doing 42 in a 30 produced her docs at the police station and her licence was one month out of date but she did not receive any letter from the dvla,her husband died around the same time she was suppose to renew her licence.what happens now and what could the penalty be?

A friend of a friend recently gave up their licence, however we found it expired last year and he swore he got no information about signing it off for another three years.

Not sure what the offence is (driving without a licence?), but I imagine if there was no reminder sent, or it was lost in the post, that would have a large bearing on what happens.

Phrases like "you silly little boy" and " Well of course I have a licence" or "can you not read?" spring to mind.

Oh my mum has so much fun with the boys in blue. Your aunt has reached the age where the law is afraid of the Daily mail. It might be prudent to drop in that she is a freind of the editor.

This could cause some problems Andy.

I presume Aunt admits the offence and would like to get it disposed of asap.

Unfortunately for the Conditional Offer to be effective then within 28 days payment has to be made to the Fixed Penalty Clerk and because endorsement/points are involved then a Driving Licence and counterpart have to be handed over. This at the moment she cannot do so it will have to go to Court where similar problems could be encountered as a DL has to be produced to Clerk of Court.

Perhaps you may wish to consider this remedy.

1. Renew Driving Licence poste haste.

2. While you are waiting for the renewal write/visit Fixed Penalty Clerk explaining the problem, that you wish to take up the Conditional offer and ask them to extend the Conditional Offer time limit so that you can produce the licence once it has arrived from DVLA. Under the circumstances it is quiet possible that they MAY do this and if they do, Aunt still gets the matter dealt with with minimum fuss and also may get away with the offence of No Driving Licence.

DVD nails it again!

Just a point for those of you with photocard driving licences, whilst your right to drive lasts until you are 70 the licence is not valid until then, I think it is either 5 or 10 years only (mine is away being renewed at the moment), so check up on yours!
