I have a fault with my electric boot, as I can't open it using the boot release button, however I can with the key fob. I thought It may have been a simple replacement of this part, but I am confused as it also opens when I release the brake pedal! Any ideas?

Is it not a security feature that the boot lock button will not work unless the car is stopped with the engine off and the handbrake on?

Sorry it releases by the release of the break pedal not the release button while the engine is on and the hand break down.

That sounds very much like a common electrical fault with the wiring in the boot. It causes the boot button to not operate and other actions, such as braking, to open the boot instead.
From what I remember, it's usually the wiring as it enters the tailgate at the top (you can see the black rubber tubing when you open the tailgate). It frays and shorts with the brakelight wiring.
