Insurance issue - they want to cancel policy
Discussion
Well, got an issue to sort for my brother in the morning as his insurance co (student specialist) want to cancel his insurance....
This policy was started in early November and has been nothing but trouble until now...dispute costing the best part of £1k paid up front.
First the request list: MOT, full license (both parts) for all drivers and a copy of the V5 and student ID, all supplied when asked with the exception of the V5 due to a burglary, although the new keepers supplement was sent and a new V5 ordered after paying £25. They were contacted re only new keepers bit being sent and acknowledged the reason, asking for a copy of the full doc to be sent when received. (sent day after it came last week).
Brother then has a call saying policy will be cancelled today due to the documents not being sent promptly (dispite the above) and according to a letter sent in December (never received any letters at this time). They then said that with further analysis a claim of my dad's hadn't been disclosed from may 2011!!! (there was none) and he is a named driver. Only thing at about this time was a motorbike accident in June/July 11 (non-fault and did not put this down on car insurance quote as not relevant).
So how do I get this resolved for him (I did quote and have been permitted to contact them on his behalf) do motorbike accidents have to be disclosed???
Is there anything saying that this is immaterial to the policy and due to hassle and if a problem just taking him off (never drives car) - surely if they still do cancel they need to give a refund as no policy doc's or any hard copy information was ever sent?
Any help from PH much appreciated!

Without commenting on the other areas, any insurance claim needs to be stated. I have to declare my non-fault car accident every time I re-new my bike insurance.
Oh pants, I didn't know that at the time but...they currently state the wrong month also....May just get him removed from the policy for ease and hope they re-instate....main thing is getting the funds back pro rats if they cancel.
Was paid on a CC which may help...

Uberrima fides or utmost faith requirement covers all insurance policies. You cannot decide the relevance of what must be disclosed. I am sorry to say the insurance company can cancel this cover at will. No redress.
What did the question say ? Was it clear ?
Did you try to answer it truthfully ? Or didn't you really care ?
They have the right to cancel, but should still treat you fairly.
If the question was clear, and you have not answered truthfully, combined with failing to send the docs .... You may be in bother.
The insurer can keep your premium if there is evidence of fraud.

Normally the question is asked have you (or your father in this instance) had any accidents or claims in the last x amount of years. At this point it is best to advise of all motor related accidents or claims and let the advisor advise what is or isn't needed.
Unfortunately, because the insurance has been runnin for the last few months, they may see the accident as reason enough to keep the majority of the payment.
example - Insurance was quoted at £1,000 for the year. Paid all at once by CC. 6 months later, new information means that the insurance quote would have been £2,000 if they had all the relevant information at inception, therefore for the 6 months of cover you have had, they would charge the £1,000 you have already paid (if you see what I mean?!)

Whilst its a pain that you can't transfer ncb from bikes to cars and vice versa, accidents to do with either need to be disclosed when renewing any insurance, .
Seems a bit out of orderIf I had had 5 fault accidents in cars and then decided to take to two wheeels, you better believe the insurance company want to know how well I get on unsupervised on the road.

I had an arguement RE: motorbike claim on car insurance...
I had a motorbike accident in 2008, 6 months later I bought my BMW 540i, I did the online insurance quote and didn't state it. I took train 200 miles to collect the car and after handing over the money and I then called the insurnace company. They said they would charge me £500 more becuase of a claim I didn't declare. WTF!
I didn't argue it at the time but when I got home, calm and relaxed, gave another call, explained it was on a motorbike and if you can't transfer motorbike NCB then how can a motorbike claim affect a car insurance premium? They refunded me back all of the difference and it hasn't affected me since.
Some of these robots of the end of the phone don't know what circumstances of the claim were, just that there was one.

So what part of the question 'Have you had any accidents, claims or convictions in the past three years?' did you not understand?I had a motorbike accident in 2008, 6 months later I bought my BMW 540i, I did the online insurance quote and didn't state it...
PH seems to have multiple threads running at the moment with people who lack a basic understanding of motor insurance.
My car insurer wasnt fussed about my fault claim on my bike, i informed them about it but they said it was fine.
This was about 4 years ago so they maybe felt enough time had passed, it didnt effect my premium, but i had told them.
Though if push came to shove i bet they would use it to not cover.
I find honesty is best policy with insurers.
Though i have had issues with some insurers regarding licence copies etc, especially after i passed my bike test in 2000, but renewed my licene in 2010, as a result my A1 licence showed from 2002, i.e. when my 33bhp restriction ended, they asked for another £20 as apparently i hadnt stated my test date correctly, they got told to f.off and lost me and my dads business.

Non Disclosure. Thats a good enough reason form them to cancel. Could be classed as insurance fraud - so wehn you get another quote, or take out insirance and they ask if you have ever had insurance declined/refused etc you will ahver to say "YES" ??Is there anything saying that this is immaterial to the policy and due to hassle and if a problem just taking him off (never drives car) - surely if they still do cancel they need to give a refund as no policy doc's or any hard copy information was ever sent?

personally, it isnt immaterial to the policy, its non disclosure. imagine if you had a crash and they then said your policy was invalid (which i hope you dont need them shortly...)
Always rememeber, that when they say calls are/may be recorded, they are. This can go against you, or for you.
I have used it twice to my benefit.
One insurance company were trying to wriggle out of increasing my property insurance 40%, which I hadn’t noticed for 10 Months. The girl on the phone went back and listened to my conversation taking out the policy at the time. I was correct, sales guy had made an error.
