what would a BiB do if...........
Discussion
you'd had a lovely 2 weeks holiday in Wales, perhaps been brave and scaled mount snowdon to the sun dial at the summit, visited port merrion and had a cappucino, etc etc etc, then got home to have 7 NIP's drop on you doormat. All for between 2 and 6 MPH over various speed limits at various times.
This hasn't happened to anyone I know by the way, but wondered what a BiB would do if this happened to them?
Curious.
B35.

What would Greengrocers think? Newsagents think? Bank Clerks think? Window Cleaners think? Steelworkers think? Doctors think?
"I shouldn't have lent my car to a foreign friend. I wonder what will happen to the NIP?"
A few of those comedians are appearing before the courts lately....

So there's been lots of investigating to prove that the comedian was driving the car? Or has "innocent until proved guilty" gone out of the window?
Surely there is no case if the picture is of the rear of the vehicle or if the driver's face is obscured?
I don't understand this. Under S172 if you as the registered keeper of the vehicle has identified the driver as required. Surely it is then upto the authorities to investigate the named driver? Now understandibly if the driver has lied he has committed an offence but if not surely he has complied with S172?

If he has supplied a false name on S172 as to who the driver is. It's not uncommon for emails/faxes to be sent to foreign countries to locate, so called drivers.

See your point street.
Don't know what I'd do. Feel victimised probably, (did after just 3 points).
Amazes me, the first time I was done for speeding (in 1990) I was driving through a 30 MPH village at 50 + (on the speedo) and didn't see the very obvious plod car parked up with his radar gun pointing out the window (which it transpired he wasn't allowed to do, but that's by the by) I saw him pout his lights on (pulse rate + 30) then rapidly catch me up (pulse rate + 45), then blue me and flash his headlights. It's pretty obvious what you've done, the following bollocking and sit in the back of the police car for 5 minutes certainly gets the message accross and I deserved it really.
The second time, overtaking an old chap who was doing perhaps 30MPH on a 40MPH otherwise empty dual carriageway. (yes I do use the inside lane) The video that I eventually got to see revealed that the plod waited until typically the fastest part of the manouvre to laser me at 50MPH.
The plain white van was parked off the road.
The NIP arrived 10 days later, for an offence I couldn't remember. (my jouney home from work everyday)
This little cash machine has managed to fleece almost everyone colleague I have at work, all for similar infringements, and more than once in some instances.
So, scameraship have a little snigger, and don't think 'oh, that's the same person again, perhaps we ought to have a word', they just send those NIP's.
Must be a good laugh for them.
The same sort of snigger you get from human vermin. Which is what they are

And if there is no answer do you then assume the registered keeper is guilty? Without proof?
That's Sect 172 for you....C'est la vie...
I suppose it's also to give respect to the 99% of people who hold their hand up and say "Fair cop"...
"Why should be only prosecute those who roll over for their bellies to be ticked and not sort out the ones who cause a fuss" a gaffer once said to me.

What would happen if it really was a foreign friend driving...a fax was sent but there was no reply because they were on holiday on something?
Are all cases where a foreign driver is named prosecuted as preverting the course of justice? If not, what criteria are used to determine which ones to pursue?

Each case is judged on it's merits.
What I would say is this;
"My mate was driving" etc is the reason so many forward facing cameras are used together with video recording from camera vans.
So if you can't ID the driver (photo and/or video) you would not proceed with a PTC-of-J charge?
What would happen if you had a photo and/or video with a driver wearing a mask and the returned NIP said "Mr A. Foreigner"?
(Thanks for your patience in answering all my questions

The magistrates would use the Sect 172 and the mask would no doubt sway the magistrates....
No probs about question answering...that's why I visit this site. I might not say the things people want to hear at times...but you get the truth from me.
