Pothole on M40 tyre and suspension damage! Compensation ?
Discussion
Driving northbound on the M40 in the snow/rain last night doing about 50mph in the left lane between junction 10 and 12 hit a huge pothole with both nearside wheels, moments after spotted what I believe was a VW Passat on the hard shoulder with the boot open and guy putting an obviously shredded tyre /wheel in the back, as my car was still feeling ok I carried on, as stopping in those conditions could cause more of a problem. Once off the motorway I checked and found a huge bulge in the sidewall of the front nearside tyre, but still appeared well inflated so carried on home, slowly off the motorway.
Today had it looked at and seems both nearside tyres are damaged and the suspension has been moved, the bill comes to over £200.
Questions : Do I have a claim against The Highways Agency, and if so what evidence do I need?
Anyone else hit the same pothole were you the Passat driver 19.30 last night, and has anyone successfully claimed against these people or is this just a case of put it down to experience and be thankful it didn't kill us all?
.
Thanks for looking.

I and 5 other cars bent wheels and ruined tyres on a bad pothole on an A road and yet the council wrote back saying they had fulfilled their responsibility in having looked at the road 6 months ago; the arrogant final sentence in their letter also stated "in any case, we do not entertain any claims made against us"
Devon Council quite helpful in my case. Went to website and filled in claim. Also looked up pothole on www.potholes.co.uk, located it and found it had been reported before. This particular pothole was hidden in snow and slush so not visible at all. It was 1 metre wide and 10cm deep. Council says it takes 90 days to reach decision. In my case I was able to take a photo of the pothole and my car. I also have the tyre with the rip in the sidewall and the report from the Tyre company.
Same happened to me in my old S8 year before last. Two buckled wheels and two destroyed new Michelin pilot super sports. Local council told me to spin!
Wasn't in a very good place (life!) to continue my claim, so let it go.
Had my circumstances been different, I would have pursued it to the bitter end.
OP, don't let it go, if you can.
My current car is taking such a battering, I've all but given up on wheel alignment - what's the bloody point if after having it done, 5 mins down the road another pothole screws it all up?

Well I tried a phone call to the Highways Agency, politely refused to do anything, state of roads weather conditions, etc etc, they are aware of some damaged road surfaces. Had to admit the tyres were not new, and as obvious from the photo and the tyre place would back it up that they were only good for another 6 months or so with average wear/ use.
Little chance of a good outcome for me, I suppose I now have some good tread on the driving wheels for the imminent snow, so will have to live with it.
I will be down the same stretch of the M40 on friday, so will try to be in the middle lane in that area, but would hope its been repaired!
