M6 diff oil change

The diff on my 08 M6 (27k miles) occasionally makes a noise on tight bends, especially when cold. It was my impression that this could be sorted by changing the diff oil. My local dealer agreed that this was the case, but that BMW would not do this free and that I would have to pay for this as the car was more than 3yrs old.
I know that this has been discussed on here before but I was not aware that the age was particularly an issue with this, it has been doing this for a long time and the car has only done 27k. I intend to approach BMW directly myself but before I did so wondered if anyone else has been refused this fix?

The car had a 3 year warranty from new, if you didn't extend the warranty, which was an option, then you now have to fit the bill.
Why is it a warranty issue? It's a well known problem that, as I understand it, occurs because the original oil doesn't do the job properly. I have got an extended warranty, but it has an excess. And the car has only done 27k miles.E30M3SE said:

Though it was £20ish for 0.5 litre bottle and a change requires 1.2 litres, so need to buy 1.5 litres.BMW part # 83 22 2 282 583
FM boost - can't remember how much this was but its only a small bottle.
3litres and 1 FM is two changes.

As you're now under Extended warranty which is insurance backed not manufacturer and as Eddie has pointed out it doesn't actually do any harm.The oil is doing it's job, it's more an issue with the modern M car owner.
