Audi nightmare - negligent service from Main Dealer
Discussion
I'm currently facing a situation where I believe Audi have been grossly negligent in their service causing me a substantial financial cost and damaging their reputation. I'd like to see if anyone had a similar issue in the past and could provide me some advice.
I've recently bought an Audi TT S-Tronic (2007) from an independent dealer in Essex. Before the purchase I've arranged for a car check and full diagnostics to be carrier out in an official Audi Main Dealer. I have fully paid for the check and was informed over the phone that the car is in a perfect mechanical and electrical condition with the exception of a few minor items (e.g. break pads) and that I will receive a full written report with the same conclusion in post. On that basis I have purchased the car.
However, already on the first drive home I've noticed strange behaviour in the gearbox (jerky movements in low gears, kangoorooing etc.). I took the car back to Audi to demonstrate the issue - after barely 50 meters of driving the technician concluded that there is a serious issue with the gearbox and will need a full replacement costing £4,000 - £5,000. I have launched a complaint with Audi demanding them to take responsibility, however to this day (it's been c. 3 weeks since I've bought the car):
- Audi failed to send me the original written test report which I have paid for despite my repeated requests over the phone and email.
- Audi failed to provide me a written confirmation of the second test where the gearbox issue was recognised despite my repeated requests.
- Audi refuses to take any responsibility for not flagging the gearbox issue.
Audi completely refuse to admit any mistake on their part and are unable to provide my any written evidence thereof which I'm entitled to. I would be very grateful for any advice for dealing with similar situations.

Audi do? Or the dealership you bought it from?
Have you spoken to Audi head office?
I'm referring to Audi (not the seller/dealership I bought it from which was an independent dealership). I have contacted Audi head office already and they've only offered repeating the check for free but not to cover any costs for repairs/replacements.Have you spoken to Audi head office?

What check you pay for?
What were the terms of the service?
What warranty and assurance did they give with the check?
Grenoble - it was meant to include: 1) Health Check with a test drive and 2) Car diagnosticsWhat were the terms of the service?

They've mentioned a warranty that applies to the check over the phone but as they've refused to send me any documentations so far I don't have any terms and conditions / diagnostic report etc. I have requested those a number of times already - but they have never delivered.
Surely your contract for the car purchase is with the independent dealer and that is where your restitution lies?
Id think you need to take it back to the dealer that you bought it from.
Although I suspect there's more to this than meets the eye. For example, why would you buy a car from an independent if you want the Audi main dealer to be responsible for it? Why not buy from an Audi dealer in the first place, then you will have their warranty. But maybe I've misunderstood?
You have no written report, only your word about their phone call. If you feel the car is duff, and was duff from the word go, take it back to where you bought it. They are legally obliged to ensure you're sold a car fit for purpose etc.
Btw, your braver than I buying an auto Audi of 7 years old as the boxes are renowned for being potential money pits!
Hope you get some joy with the dealer you bought it from. Wy not see if he can get it fixed?

Why haven't you taken the car back to the supplying dealer and told them to fix it?
I can understand you being miffed by the poor advice which you received from Audi, but your contract is with the Dealer who sold you the car, and it is they who will have to repair it, or refund your money.

Catman - how do you force the seller to take back the car? It is a small dealer and he is categorically refusing any return/repair. He claims he sold the car to me as a trade sale and as such I have no rights. I will pursue this further with the seller in any case but regardless I believe Audi need to recognise some responsibility here.

You don't need a warranty, the car has to be fit for purpose and the Dealer can't ignore this.
You need to be ready to take him to court if necessary, but I hope that it won't be.

What he said. You have the protection of the Sale of Goods Act.You need to be ready to take him to court if necessary, but I hope that it won't be.
Tim
Your dispute with Audi is secondary.
