I have been looking at one of my parent’s will to ensure it is still relevant as it was originally written back in the early 70s.

A couple of questions have arisen.

First, one of the executors/trustee is a solicitor. I Googled the firm he worked for but it seems they no longer exist; is there a way of finding out what happened to them?

Second, this clause is in the will;

“All of my residuary estate not applied or disposed of under the foregoing provisions shall be held in trust for my said children or such of them as shall attain or shall have attained the age of eighteen years and if more than one in equal shares.”

The “foregoing provision” referred to is now redundant as it was only applicable if any of the children were under 18 at the time the parent died.

The will doesn’t go on to explicitly state when the trust is payable to the beneficiaries. Does it have to say so? Or, is this the way wills are written and it is implied the estate proceeds will be paid out on death?
