I am looking for advice on the "counselling into position" of employees within a company.

Said company has gone through a recent restructuring process during which certain positions have been removed from the structure, making the employee "displaced". These displaced employees have then been counselled into other new positions on the structure, that may have been of interest to other employees (potentially better qualified). This has happened without jobs being advertised or interviewed for.

What are the legalities of this? Does the company have an obligation to offer "displaced" personnel a position without competitive interview?

It should be added that this treatment has only been given to certain people, others have had to apply for other jobs and perhaps settle for a job of lesser grade. Also some of the jobs that people have been counselled into are very similar to jobs that were previously removed from the structure.

Any advice gratefully received...

This sounds like a redundancy situation and those employees whose roles have been made redundant are being offered redeployment into suitable alternative roles. The company is obliged to seek suitable alternative roles within the company or group of companies. Can roles be ring fenced for employees in a redundancy situation? Yes.
