What am I doing wrong? - Photoshop

I'm trying to record a batch action in CS6 and it just doesn't want to work...

I have a CR2 file open in PS (not in Camera Raw), I want to save a full size JPG out of it, without closing it, so I can apply other batch actions to "open files".

I've recorded : save as > ticked "as a copy" > best quality > ok > stop recording

When I try to apply it to "open files" instead of just doing it automatically it opens "Save as" menu, then I have to manually tick "as a copy" -> "best quality -> OK and it closes the file.

What am I doing wrong while recording/applying the action?

Don't know why that doesn't work, but if you make your first steps 'image>duplicate' then 'layer>flatten image', it should bypass the 'save as copy' dialog.

Do you needs to set a naming convention when doing a save as? (Just a guess, I have no idea about PS).
