My MIL runs a small business where one ex employee decided to claim for a bad back. He tried to claim 20k and after probably two years of squabbling between insurance company's and the no win no fee people they agreed on 3.5k on the grounds that although he didn't have a leg to stand on the company didn't complete all the necessary training they should have.
Whst I'm wondering is how much of the 3.5k would the employer actually see. Would there be a percentage or a fee to pay out of this. As i presume they see it as a 'win' as he did receive a pay out.

Normally the £3500 will go to the employee and the legal costs will be paid by the insurer on top direct to the solicitors.
