The tracking number provided by seller says item is delivered. the seller says i need to contact royal mail and lodge a claim? isnt it up to the seller? there is no signature on the royal mail website.

Tell him to do one, he sent it, he needs to refund you and he needs to lodge the claim.

Lodge a dispute saying it wasn't delivered to you and you don't recognise the signature.

Private seller or retailer ? If it's a retailer they have to comply with DSR , distance selling regulations . Google it and you'll find where you stand . Andy

As far as I can remember (from the last time this happened to me), the contract is between the seller and Royal Mail (or whoever), which means that Royal Mail cannot enter into any kind of dialogue with you. As a result, it is down to the seller to chase it up. If they are not willing to do that, then tell eBay that it hasn't been delivered to you.

Good Luck!

+!

If it was an expensive item you would expect it to be sent via Special Delivery.
Have you been able to manually input the details yourself into Royal mails site and check that not only is there a signature but that the signature relates to somewhere in YOUR area.
What I mean is that he may have simply put the wrong recorded reference down at his end.

i raised a case and escalated it to customer support. The buyer said I would have to wait until they had sorted it out with RM. Anyway ebay have ruled in favour of the seller and are not going to refund me. Im now in the hands of the seller hoping he will refund.

You will just have to wait then. It's clear that the seller is trying to sort the matter out. He will supposedly raise the claim with Royal Mail then when they sort that out refund you.

If the seller can prove that the item was received by you (need to have sent it on a delivery service with the minimum of a signature) then you don't have a leg to stand on.

If the sellers tracking says it was delivered to your address and signature received, then ebay will almost 100% side with the seller (unless they have a history of problems like this, then they may look into it more..).

If the seller sent it on a service with no signature or tracking, then they first need to check the address they put on the package (it should have the postcode on their receipt). If thats right then its worth you checking if its been put in a "safe place".. Shed, wheelie bin, in a bush, under your car? Stuff like that. Maybe they left it with a dishonest neighbour?

Regardless, if the seller cant provide tracking with a signature, ebay will most likely side with you. Open a dispute and let the seller prove his innocence.
