It is looking decidedly ropey and the mot is just about to run out with the seller going on about how he's not mechanically minded which sounds like he's trying to cover himself when you spot the engine is made of cheese.

Anyway I still fancy it for some cheap arse end out tuition as I've never had a rwd motor with enough grunt to discover the beauty of it.

A lot of wear to the drivers seat bolster for 104k miles... my car has over double that amount of miles and the seat is nowhere near that bad...

I'd be wanting to check historical MOTs for mileage records....

Test runs out November and I would guess the seller knows that it will fail its re-test and very badly. Otherwise he would test and sell it with a full 12 months. I say walk away.

This. Never trust a car with 1-2 months MOT!

Run. Run away.

The e46 330i is a superb car (yeah, I have one wink ) but they can be money pits. My '53 plate saloon is a great drive, but you need to keep on top of them or it'll drive like a dog.

Suspension/tyres need to be tip top.
Cooling system (water pump/thermostat/radiator) will need replacement
Rust won't be easy to fix (and that one has A LOT of rust).

You want to buy from an enthusiast who's loved it.

This car will be a moneypit. Even if you won it for say a grand, you'd probably have to sink another 2k into it to get the mechanics up to scratch and bodywork. For 3k, I'm sure you can pick up a nice 330ci that's been looked after.
