'Bulb out' warning light. Mot failure?

Just a quick one, E46 320 is showing both tail lights out on the dashboard, yet all the lights at the rear work fine.

It's obviously an earth issue or whatever, i'm looking into it.

Just noticed my Mot runs out tomorrow. Will this constitute a failure under the newest set of rules?
