Cycled past an accident this morning, along a main road, 40mph speed limit single carriageway. A bloke driving a mondeo had stopped to let an alfa turn right into a side road. He flashed her across, but as she was crossing his path an old land cruiser 4x4 thing slammed into the back of the mondeo, pushing it forwards, hitting the front nearside corner of the alfa. Was quite a lot of damage, especially the back of the mondeo.

I think the 4x4 guy was at fault, but surely the mondeo bloke shouldn't have just randomly stopped in the middle of the road?

4x4 guy is in the wrong but stopping on a clear road to let others out is monumentally stupid as can be seen hence the consequences. One person not paying attention and bam.

something being stationary in the road dosen't give you the right to hit it.

4x4 is at fault - 100% in terms of insurance IMO.

Mondeo doesn't have to worry but Seat may require statement of Mondeo driver to get settlement on a non-fault basis.

4x4 driver but it totally baffles me when people generously let others out by stopping in a road and inconveniencing many more people behind them. The utilitarian in me just doesn't get it.

I would say the Mondeo was at fault, I failed a mock driving test for letting someone out of a junction as I was approaching as it was deemed 'unsafe to the users behind me' who wouldn't be expecting me to stop.

Saying that, the 4x4 should have had better anticipation but really don't expect somebody to stop dead on a 40mph dual carriageway...

CCC = Courtesy Causes Confusion - or crashes in this case. That's what I was once told on an advanced driving course.
