Warning - Mini Courtesy Car Insurance Excess

Hello,
I was wondering whether any other forum members have had a bad experience with Mini/BMW and courtesy cars?
Our R56 mini cooper s was in for some work (again...) with a Mini MDK. They gave us a 320d as a courtesy car with a £500 excess whilst the work was being done. Unfortunately we had an accident which caused £1800 worth of damage to the courtesy car, which was not our fault, and admitted to by the other party.
We paid the £500 excess on the assumption that we'd get it back, when the dust had settled. Guess what, even though the blame has been agreed in our favour, we're not getting our excess back. The MD don't seem to care, saying its nothing to do with them, check the insurers. The insurers say vice versa. Bottom line, "its not our problem".
Has anybody else been in a similar situation or got any suggestions?
We won't be using this MD again, customer service is pretty shocking

ask for written conformation that the excess will not be returned to you, take a copy of that to the insurer who is liable for the claim
if the dealership have not declared to the insurer that they have retained your excess and have claim for the full amount of the repair
