Sunny boy parked up at college without paying for his permit one day. I am the registered owner of the vehicle and have now received a charge notice issued by TPS for £90.
The notice states that the law has changed effective October 1st 2012.
I am not convinced that companies like this can issue these kind of notices and am thinking of ignoring this letter.
Is this a good idea or should I pay up as a good citizen?

Very useful comment.
We tend to fight from the same corner in this house.

The law has changed and private parking companies can pursue the registered keeper for parking charges. There's about a thread a week (at least) about whether or not these charges are penalties, liquidated damages, enforceable or unenforceable. It is the case now that PPCs are now taking registered keepers to court, sometimes they win and sometimes they lose, depending on the evidence they can present.

You are liable as the registered keeper, as long as they notify you within 14 days.

Check out the pepipoo forums, loads of info there.

Speak to the college - explain the "hardship" it would cause to a genuine student?

Of the 1.8M tickets issued last year something like a dozen went to court - of those a few poorly defended ones lost. The odds are very much in your favour. Personally I've ignored 3 - of which 2 weren't followed up at all and the other tried a single threatening letter. So far 3-0 to me.

Doubtless you will get 57 varieties of replies on here - I know which I'd choose.

That's changed though since POFA was introduced. There have been several thousand cases filed by one PPC alone.

Don't panic though - most of these tickets can be beaten - I'd head over to pepipoo for advice.

That's Parking Eye. They rely on ANPR technology. It requires a physical person to check whether a permit is displayed.

Total Parking Solutions don't appear to figure much in court.

Agreed. Nothing to lose by doing so. Have a look at these threads before posting on pepipoo.

One point worth mentioning. A parking issue at a Uni can potentially be a slightly different kettle of fish. TPS have an extra tactic that they can use. They can report the VRM to the University authorities who will be able to cross match it with the application by the OP's son. It is conceivable that pressure might be brought to bear by that route.

I have heard of someone being refused their degree for not paying charges/penalties resulting from refusal to pay for breaches of parking rules on campus. It may have been for more than a one off incident though and therefore a flagrant disregard for the rules governing student conduct while attending the Uni. Equally the story is quite possibly an urban myth.

OP, which Uni is your son at?

14 hours and nobody has suggested the OP be shot as he might be fronting. This place has changed!

Anyway, OP, I'd have a look over here:

and follow the link there to "advice for newbies". Can't speak from personal experience, but looks sensible.

Fronting? Whatever......

Just noticed that the actual ticket he received on the day says 04.11.05......despite it being 2013!
Surely this means the ticket is invalid?

Anyway, told him to speak with the college principle to get this parking offence annulled, see what happens.

If students are exempt from the parking rules then they should be given a sticker to display so they don't get ticketed. If they are not exempt then the Parking Control Company is not going to be happy having legitimately issued tickets cancelled. Assuming the Principal was involved in the decision to engage a PCC he won't be keen to dabble in their business.

I have clocked up about 35 of the buggers over the past year....

Ignored everything, had 5 letters per ticket saying pay now or else - first 2 increasing 3rd at the highest and second 2 decreasing the amount until they stopped.

Haven't got another in about 4 months now and hasn't been an issue smile

Much disappointment here that this hasn't been picked up on - see OP's profile.

Not quite, majority were for returning to somewhere later on in the day and the ANPR camera on entry/exit not logging the events in-between

Excellent idea, then he has identified himself as the driver and the principal will hopefully offer to defer issue of his diploma/certificate until after he has paid his debt.

This isn't some random car park where there's no come back if he ignores it. It's a college car park and i'd bet that ignoring the ticket will have consequences.

Fair point (had a few at uni too) as my permit regularly became un-stuck from the dash/I refused to park my car in the large car park where they were regularly broken into (had to keep £2k's of golf clubs in the boot) so parked in the smaller close, protected car park out of the way but not in an officially marked spot.

These were also ignored without issue, if the university had have contested my degree I would have reminded them that they had sub-contracted the parking to Parking Eye and as such any debt, although disputed, was owed to them and not the University and thus they had no claim over the funds directly.

This was pre-law change a few years back though.
