How long between NIP & court? HELP!

Can anyone help?

My company received a Notice of Intended Prosecution for my company car in early June for the offence of 99mph in a 60 zone (A449 in Gwent) on 30th May. This was returned. The next correspondence I got was in July, another NIP asking me to declare if I was the driver of the vehicle, which I duly returned.

I called the Safety Camera Unit on 8th Sept. They had it and were dealing with it. Heard nothing, so I wrote to them on 13/10 asking what is happening.

NO reply / correspondence at all.

The Question for any knowledgable Piston Headers out there is

Is there any legal time limit by when the magistrates court has to summon you?"

Has this happened to anyone else? If so, what happened?

Any other useful advice?

I just want to get it over and done with, rather than spend forever waiting.

No mate i think that they have acted within the guidlines this time.

They have to serve the NIP from a fixed penalty camera site within 14 days, which they did...

As for the rest, did you confirm that it was you who was driving the car, if so,you have already admitted the offence and im affraid you may well have to go to court over it and take whats coming.

My best and only advice i can give you is, if your guilty, i would plead guilty and accept it.

Plead guilty by post (if given the option). They cannot ban you unless you attend court. However, 33 over, is likely to result in a summons, then you know you're in for a ban..

If you confirmed you were driving did you accept a fixed penalty by returning your licence with the fine?

If not, another thing to consider is the validity of their evidence. Was it a fixed camera or a mobile one?

If mobile plead not guilty and ask for the videotape, and also the police number of the policeman who formed the opinion of excessive speed, remember the speed measurement device is only corroborative evidence and cannot be used without the policeman's opinion.

If fixed camera, plead guilty and await punishment.

This is 'man in the pub' advice. Some of it's correct, but some flawed.

Basically, they have 6 months to lay the information in front of the beaks.

99mph will almost certainly land you with a ban, but not definately. That's why you weren't offered a fixed penalty. A day out in court beckons.

DON'T keep phoning them up and alerting them to your case. Just let it be. No news is good news after all.
