I think then that's the midland box which has issues ....strip and investigate but 5th gear syndrome/baulk rings needed at a minimum.
Might be cheaper getting an exchange rebuilt one.

The 56 mini cooper S I have just bought has had a refurbished gearbox at 40,000 miles which I did not discover until I started going through the history. I believe it is a common fault on the mini. I also had to change the clutch and flywheel which involved dropping the engine out soon after I purchased it again a common fault. Think the new box was around the 2k mark.

My understanding is that the Cooper s gearboxes are very robust and don't generally suffer with problems, yours must be an unfortunate experience as its the box fitted to the lower end minis that do have a Known history of issue's.
