Soooo, I won a Volvo on eBay last Thurs, paid the deposit via Paypal straight away as he requested in the listing, arranged the recovery agent for Monday and paid bank transfer on the Sunday. Maybe risky, maybe not. Anyhow, it was listed as spares or repairs, but excellent body condition so when the recovery agent pulled up with a patched up Volvo on it's back, with no power steering and a non working cab roof, I was annoyed as the steering wasn't mentioned, and the roof apparently worked

I spoke to the guy basically saying I reckon he's been abit sneaky with the description and maybe, as I'd been good and stuck to my word regarding payment quick etc, we could come to an agreement about a few quid back. Wishfully thinking I know, and was my own fault for buying unseen. He said he'd ask his boss, but then stopped responding

I gave him a few days, still nothing, so I thought sod it, write it off as a bad do and just get on with life! I gave him negative feedback, fully justified saying wasn't as described and that was that

Now however, I have an unpaid bidder case against me?! I've thought about it, and if he says I haven't paid, then he'll get his listing fee back, final value fee back, and the negative feedback removed, as the car 'never sold'?! I've spoken to eBay, but because I paid bank transfer, they have no proof I paid. When I mentioned I thought he was being fraudulent with trying to get fees back, they were interested but it's like trying to get blood out of a stone as it's like I'm talking to a computer.

I just think it's wrong, and there's nothing I can do about it!

What does a non paying bidders strike against me mean in the long run?

Not much consolation, but that is why you should pay using Paypal and absolutely no other way.

I think you're allowed three non-payment strikes before it becomes a problem (I THINK). You paid (a deposit) via PayPal, which should clear you, as you have paid the requested amount (assuming he sent you a request for payment). You could possibly open a SNAD (significantly not as described) dispute which should win you your deposit back.

Edit. Thinking about it, it's possible that eBay rules regarding motors are different from those applied to other types of goods.

Surely, if the transaction is cancelled by ebay as part of the dispute your paypal part payment will be refunded?

Ha, I have to laugh as he's got it sewn up

I paid via Paypal only a £20 deposit straight to him, no requests or links from eBay

I didn't send it as a gift however

Well stitched indeed. That's an expensive lesson you've bought, learn from it and your moneys not entirely wasted.

I see the Volvo you bought and TBH no pictures with the hood down means in my book it don't work.

Sneaky yes. One you need to chalk up to experience I'm afraid.

I would never, ever, accept paypal for a car. Their payment could bounce a week later and the money will be recovered from your bank account

I really struggle to understand why people would buy a car unseen. How much did you pay and what model was it?

Ebay doesnt give a crap to buyers, its all about sellers/power sellers and dealers. Its NOT an auction site any more!

I don't understand why people keep using ebay when this sort of problem is common place.

But you have proof of payment, just send ebay copies of your statment or a picture showing the money has been transferred? Give them the ref and as much info as you can.

I'd be fully expecting to read about all faults, especially as big as PS not working and roof not operating.
That's a but of a s trick really. I'm only half an hour away from Harrogate, too!
Any way you can cause his aggro through further ebay listings or a website (you mentioned he had "a boss")?

Indeed - I have had an interest in a few cars and in all cases gone to see them in the flesh before I bid.
In EVERY single case the car was tattier than described, bits didn't work, rust wasn't mentioned - the list goes on. Really if parting with any amount of money you do have to go see it first even if the journey is a pain to do.
If it's serious mileage I am sure a local Ph'er wouldnt mind going on your behalf for a bit of beer money....

counter claim saying you don't have the car. He'll have to prove you do. What evidence does he have?

That's rather expensive for what it is. I bought a fully working t&t coupe for just under £200 more............
