From 'At fault' to 'Driving without Due Care'?

Hi there, only my second(ish) post!

Just wondering - at what point does a traffic accident between two cars which results in a seemingly straightforward, painless insurance claim turn into the 'at fault' party getting a ticket for Driving without Due Care and Attention from the police? What's the main factor in going from 'everything going smoothly and the guilty party losing their no claims bonus and having a fault claim recorded' to 'this person is now Driving without Due Care'? Because surely if you're at fault in both instances then there must be something that would make the police think you were (this is the last time I'll type that phrase, I swear!) Driving without Due Care, in my eyes, as opposed to just deserving a removal of your no claims.

Hope I've phrased that correctly, just wondering!

I suspect that most crashes have a component of driving without due care as a minimum, but if no one calls the Police, or they decide they don't need to attend, it's not going anywhere.

I would certainly have liked the woman who rammed my stationary Jag with her RR and then had a go at me because she'd lip read me utter an expletive in shock at the force of it and anger that anyone could be so crap get done for being a generally offensive person. But as in 99.99% of the time I spend on the road, there was no 5-0 anywhere to be seen, and I don't think I'd have been thanked for summoning them (or even trying).

Thanks! Just had a read - so what we're basically saying is that if the crash was quite avoidable, and the police attend, there's likely to be a risk of being done for Careless Driving? Seems a bit hit and miss if I'm honest, but that's the way the world goes!
