Sorry to bother you all, (bit of a ghost reader on the forums) was looking for some advice on situation im in?

Will try to keep this short and sweet so here we go. I'm currently working within retail at supervisor role, currently suspended with disciplinary due on Monday, where i'm certain to be let go/sacked (however wish to word it) i've admitted fault as understand was against there policy, Case of ive gave customer wrong item when they refunded an item, purely because I didnt check etc, stupid mistake really but my mistake which is fair enough so cant really argue that. Was wondering is it better for future prospects to just quit and almost leave under my own control? or is it better to be sacked and just be up front and honest with whats gone on to future potential employers? Also where would I stand with references, eg would they still provide one just to confirmed work there from xyz-now or best to avoid that completely? Sorry for such a basic question just really unknown/confused and almost panic.

Any questions/detail needed please ask and will go into further, be it via here or PM.

Your going get sacked for a silly mistake? which you had no intention of malice/personal gain.

Best to just resign, if your being treated like that your best off out of the company anyway. Get something else lined up though asap, voluntary work, anything so you have no gap in your CV and a valid reason to move on.

How old are you? How big a cock up? how likely are you to need to claim JSA?

I would suggest leaving is always better than being kicked out so if it's 100% that you will be sacked, hand your notice in imho.

It may help if you could give a bit more detail -

What was the mistake?

Is this your first disciplinary problem?

How long have you been employed?

From what I can see you can't claim JSA for 26 weeks, either if you resign or are sacked for misconduct. How long have you worked there? Is what you've done really considered to be gross misconduct, you are being very sketchy on the details.

If you have been there less than 2 years is it possible they may just decide to let you go, rather than dismiss you for misconduct. Only you are in position to know these things.

If it is a simple mistake you might get a verbal warning...a bit more serious, then a written warning. Which, as long as a similar incident doesn't occur again, won't be a problem.

I think you'd only get the sack if they seriously suspect you/ have proof of fraud and serious wrong-doing - then it would be gross misconduct.

Resigning would be ( in their eyes) admittance of guilt - so I'd suggest waiting to see how the disciniplinary goes. You're allowed to take a colleague in with you to the disciplinary, so I suggest you do.

Whether you walk or get pushed have someone proof read your application letters / cv.

Are you certain you're going to get sacked? If it's just a little mistake as you put it, why would you be sacked? At most you'd get a warning.

So either they aren't going to sack you (so don't jump if you're not going to be pushed) or you're not being entirely truthful about the magnitude of this 'little mistake'!

Sorry was vague with details, didn't want to make it too boring, so history for myself, already on written warning, due to conflict of interest, I used to do some eBay trading on the side selling various clearance lines which used to buy at auction (products sometimes similar to what sale there other times it be complete opposite way) (the previous tbh I could see why there an issue there and didn't have problem with them pulling me up on that, Mistake wise basically customer came into store for exchange on faulty product, I swapped the faulty item for the product I thought was the same one/correct one which later been shown it isn't the same one, Case of me not checking correctly what it was (one cost £6.99 other £24.99), in that case was just an mistake down to my own lack of care? (think best way of saing it) Been employed there for coming upto 3 1/2 years.

Thanks Hackney will do! think the CV the one ill need to get looked at!

I'll avoid naming them as don't wish to cause any issues for PH, In basic yeah, Think when look at it from previous case along side this one then there trying claim I did it on purpose/gain? but with this one its just my balls up due to me just not checking?

When was your written warning? they don't stay on your file forever. It may be that your disciplinary record is effectively clean again.

Have a look at the company handbook ( if there is one) on disciplinary procedure. From the sound of it you're likely to get another written warning, the worst you'd get is a final written warning rather than being sacked for gross misconduct.
The customer who you replaced the faulty product for is a total stranger/ regular customer rather than a family/friend?

If it's true that you can't claim JSA if you're dismissed for misconduct (don't know as I'm not UK-based and fortunately never needed to claim when I was in UK), then I'd be inclined to consider handing in your notice.

If you're still trading on Ebay you could maybe "massage" your CV by indicating that you left to concentrate on full-time trading, but had a change of heart? It may also help if you had a referee from an earlier employer - you could more easily explain lack of references from your last employer
if it was a small private company than if it was a large company with personnel dept etc.

The JSA side ill have to look into, don't really want to claim it if can be helped but thanks for the advice with CV, I do still trade here and there and sure be something I could pick up again. Company wise pretty large (biggest in UK in its sector) Thanks for the advice all!

I'd wait for Monday and if they fire you on that thank them for helping you realise they're a bunch of petty wkers and you look forward to meeting potential employers out there who arent total nobbers.

Your call on that one though hehe

If the worst happens, it's explainable in a way that can still put you in a good light and if it does come to that, you can show you've learned a great lesson in checking your methods in future. I'd ride it out and see what waves come your way.
