Redundancy while off sick

As the other redundancy role is getting helpful answers I need some advice. I am at risk of redundancy/ in the process of going through the alternate roles. I was due to hear back on an internal role after Easter but over the Easter break I managed to injure my knee badly enough that I have a 4 week sick note that may extend depending on how It heals, am I safe from the company making me redundant while I'm off sick?

OK so I assume they would need to write to me to start the process? I kept on being told prior to the Easter holiday that I hadn't lost my job, and the company had told the union that there where no redundancies on site.

as you are already 'at risk' you are in the pool if this is formally in place, however they can't just jump to making you redundant becasue you are off with properly certified sickness .

also some HR depts are reluctant to push things while people are off sick becasue it sometimes comes back to bite them when the 'sickee' is either really ill or their period of absence is down to a Mental Health issue .

The pool is one person large, they are restructuring and have introduced a management role that encompasses, and replaces my role. To be honest I'm not 100% what is happening.

Yes, they can make you redundant while sick, but they should be letting you know exactly what is going on and having a series of formal meetings with you, or telephone calls if you can't make it into the office.

Thanks that was the info I needed my worry was that I'd arrive back from sick to find the process had been going on without me.

Well received a letter from hr:

Starts with a sorry you are unwell, then a restating that I didn't get the managment role and saying they are looking internally and externally to fill it.
Then a request to ring in to discuss if i am interested in any other group roles and for feedback on another internal role.
Then ends with:
"I would like to reiterate that we are still in a period of consultation with yourself so please contact me if you have any further questions."

So if I'm reading this right its the to really step up my attempts at finding another role else where.

You need to know when the consultation started and when it formally finishes.

If it is "over" this week the you could indeed be redundant very soon.

Are there other roles, hae they discussed a settlement package with you ? Perhapsyou could offer to take voluntary redundancy now in exchange for an enhanced package

Nothing has got that far yet as far as I am aware and the union are fighting the redundancy as supposedly there are no redundancies on site. There have no time scales mentioned or packages I suspect they want me to stay till the management role is filled so I can either train the new person or to keep the work being done.

I suspect they wouldn't accept voluntary redundancy, as they are "replacing" my job with an expanded management role.

I wouldn't be so sure,

If there iis an assurance from the management to the union that there will be no redundancies, then going quietly for an enhanced package might well suit the management.

Why not be proactive about this and see what you can get ?

" Hi, as you know I am on consultation, I know you are trying to hire a manager, if I commit to staying until the role is hired, and then for a two month handover after which I will accept a formal redundancy agreement with you, would you in return be prepared to enahnce my redundancy terms to X "

if you have a decent spell in the company and are well thought of, then who knows ?

Of course, only you can decide and of course there may be other roles for you, I don't know.

I suspect the new role has come about because of muttering about how I do the job, I was under performance management following an odd investigation where I never fully knew what I'd supposedly done wrong, besides what would be a reasonable package following 3 years service.

Depends on your Notice period, if you have a three month notice period then three months plus three weeks would be statutory.

If you have a months notice then getting three months money would be a result...

The Informal talk with HR was Three months in lieu of notice then statutory redundancy, no one has really told me what the package on the table at the moment would be.

Well I've had another call from HR and it looks like things will start progressing redundancy wise in the next few weeks.

I need it I'm st at getting jobs so I was hoping the decision to move on would have been mine.
