At present there is someone working 9 hours a week and is unable to work any more hours due to the other job they have taken on.

There needs to be someone in the office more often and with a few more abilities. However there isn't the budget for 2 people.

Sow hat are the best solutions?

Job share? Failing that, the business need could be a potentially fair reason for dismissal, in the catch all class of "some other substantial reason for dismissal", but it would be prudent to try job share first.

How long has current employee worked for you. If under 2 years you can sack them and employ someone else.

Maybe the option would be to offer them more hours and more money so your job is more attractive to them than their other one??

There's not much to go on there to offer any advice. In simple terms; you want the existing member of staff to do more hours but can't due to other commitments? Either convince them to stop what they're doing elsewhere to come and work for you for more hours or hire someone else to fill the gap (job sharing they sometimes call it). Is there more to it?

Under 9hrs a week is essentially just a temp job isn't it? Perm job is 16+? Just give them their notice and get someone else imho.

Ignore that last post. A part time worker with the requisite qualifying service has the same protection against unfair dismissal as one working longer hours.

Could you not use BV's "Business need" reason coupled with a compromise agreement (i.e. give them a bonus to bugger off and not bother you again)?

Well, it was a pretty good launch of foot into mouth. Seriously, though, employment law is a moving target, so helpful amateurism is often a bit unhelpful.

To help me understand then what might the consequences be of ejecting someone who does just 9hrs a week? Assuming they've been there over 2yrs of course and do indeed have some rights.

Same as any other employee. The dismissal would have to be for a potentially fair reason and the employer would have to follow a fair procedure.

If you had 2 part time staff members, would it make sickness and holidays easier ?

My wife would happily take on a job of 9 hours over 3 days, as she recovers from ME(Chronic Fatigue).

as m'learned Breadvan points out thhe contracted hours of a role do NOT affect the status of the job.

a temporary job where you are employed directly would tend to have fixed end /renewal date ( slightly different for agencies where unfavoured staff can be on the agency for months or years as they aren;t good enough to get a substantive contract but they don't do anything daft enough to get 'cancelled' ...

I would but you don't accept emails.

In truth, long slow recovery since 2006. NOW she just paces herself, does nothing strenuous, Needs 10 hours sleep, needs an hour (or 2) in the afternoon, needs to plan weekends away carefully, takes the dog for a walk on the beach every day.

If she does "too" much she gets flu like symptoms, her temperature control goes mental, her legs and arms ache, and she get dizzy (due to extreme fatigue)

Hate to come across all reasonable and stuff, but as a first step I'd try simply talking to them openly, unless there's something significant we don't know.

I'm assuming at 9 hours a week doing something like office support it's not like they're depending on it to pay their mortgage and feed their family. They might well be glad to get out and think they're doing you a favour by coming in for those 9 hours. Or at least be able to increase their hours at the other place easily.

It sounds like she's going down the CBT route, which seems to work really well for a lot of people. Sadly, not for me, but it did for a mate of mine. Glad it is for her though!

I've started a treatment with Adrenal supplements and DHEA but that doesn't appear to be working yet for me but I have another consult next week to see what we can re jiggle dosage wise.
