E36 328 written off; what shall I do?

So, I got a call yesterday from a chap who said his mother had driven into the side of my car and caused quite a bit of damage.
He seems to want to pay up; which is great, I have no need to deal with insurance companines if I don't need to. To get the damage fixed would be about £3-4k; but the car is worth £900 tops.
I've just put a years ticket and two new tyres on it, what do I ask him for?
Should I say I want £1,200 and then sell it for spares on ebay? Or is that being a bit cheeky?
Obviously this is inconvienient and I love the car but I don't need it daily...

The only advice I can give is get your money asap if you are not going through insurance. The slightest whiff of delaying should have you calling the insurance.
If it is anything like my experience it will start with the promise of payment, then they want their mates to see the car for second opinions and before you know it you are having a fist fight in the Tesco petrol forecourt with some bellend that thinks a 2008 Aygo is "worth £2000 tops bruv".

That's just the luck (or otherwise) of the draw. In reality you are entitled to the value of the vehicle (£900) less the scrap value (I imagine £120 or so). So by getting £900 you'd be doing better than you should in any case.BenjiA said:

Mate, if its £900 tops, you can't add the £300 to the £900. If you go back to before the MoT, what would it have been worth as a car with a few weeks MoT and 2 bald tyres? If you want to take the £300 into account, add it to the pre- MoT valuation...Two ways of doing it IMHO.
1) he buys you a comparable replacement 328 that you are happy with for a fair price. He keeps your old one to sell bits off to claw some cash back. You have minimal hassle & a new car.
2) you take the cash offer of between £900-£1200 and keep your car, source a new 328 & sell bits off the write off to compensate for your time & hassle.
Both fair ways that are a reasonable solution.

The OP has a 900 quid car that just cost 300.
Now if he was selling of his own volition then the car is worth 900 but given that he is now inconvenienced, has to buy another car and basically has had a bad experience through no fault of his own it is not unreasonable to chat to the other party and explain the issue and request 1200.
