MOTs and Engine Management Lights

Quick question: is the EML lighting up on ignition and then going out an MOT requirement? I'm sure I read something like this not long ago.
I have a 330 and my EML is on constantly due to a VANOS seal non-issue which all M54s of this era no doubt have. I got bored of looking at the light, which would sometimes go out, so I put a blob of tape behind it as it's not something that mechanically affects the car. Seems pointless to take my clocks out the remove the tape, get charged to turn the light out, have it come on again the next day, then reapply the tape.
Googled test regs but can't see it being covered.

I think it is a non issue and an advisory at best, but I am not sure. Rather than take apart the dash and tape it, why not get a code reader and then clear it when the code comes on? However it would be best to check with a tester.
I bought a code reader and turned off a while back but it just came back on after about 10 miles. It irritates me illuminated constantly and I don't have the willpower/energy to turn it off every couple of days, which is why I went for a tape bodge.All other warning lights illuminate and go off as they should and the car drives fine.
The amount of misinformation in here is ridiculous.
A constant EML is not a failure in itself, and at worse is an advisory (dependent on the tester). However, they do require your warning lights to light up with the ignition, so therefore OP your car will fail as your warning light will not be visible.

This was my original thinking, although can't find an official source. Maybe I'll just tell them there's some tape over it and if they really want I can go and remove it if they fancy making my life difficult. Regarding your diagnosis though, I am not aware the Vanos seals typically do trigger the EML on M54 engines. Performance is degraded because the timings aren't advanced and retarded optimally across the rev range but, as far as I am aware, it doesn't trigger EML. That's not technically true either only some lights are tested to come on and go off mainly abs which has to do the self test, traction control is another to.A constant EML is not a failure in itself, and at worse is an advisory (dependent on the tester). Air bag is a failure to but if no lights come on its pass and advice if a light is on its a fail.
EML is not a part of the test (as you mentioned) at all but might be noted as an advisory depending on tester
