I wonder if anyone can help me... basically, I am trying to ascertain at what point a deal is struck as a buyer from a trader...?

I agreed a purchase of a Bentley from a used car dealer. I could not view the vehicle as I was abroad, so I paid for a Bentley delaer to inspect the car (the vendors agreed to this).

The inspection showed a few points - the major ones being brakes and tyres.

I said that I was not going to go ahead - but the salesman asked me if I would buy it if they replaced tyres, discs and pads all round. I said yes, so we agreed the deal verbally.

they agreed to change tyres/brakes. I sent them the money (almost £50k)
Then the MD said the sale cant happen as will cost them too much to do. After a lot of back and forths I agreed to pay for the brakes - they agreed to pay for the tyres.

Today they say they dont want to sell it again!

I emailed them the full information concerning the sale after agreeing everything, and paid them in full.

Are they obliged to sell to me, and complete the work they verbally agreed, and that I confirmed on email?

Can I take action?

Personally I'd be glad to get out of the deal with any deposit refunded. What sort of after sales service do you think they will offer if something goes wrong?

very true - but you know when you have set yourself on something - these guys just been messing me around for over a week... 3 times its been done - then they say no

Sorry I can't help with the actual question but I know it would be a pain in the arse to take action. It would take time and money, all the time the car will he losing value (probably) and won't be in your possession and meanwhile they have your £50k in the bank.

Personally I'd take my money back asap, move on and find another car.

In theory you could potentially sue them for loss of bargain, but life is generally too short.

They agreed to sell, you paid. Car is yours.

Other that that, is it the only one available at that price? If not, I'd be inclined to move on.

yup - I know you all make sense... But these guys have really p***ed me off...!

Get my cash back is probably right - but I am very picky about spec, and annoyingly this is the one that ticks the boxes!

Personally I'd get my money back and find another car. Then spend a few hours over the next few weeks dicking them about over my 'wasted time and costs'. But then I don't like to deal with shysters and those who are unable to stand by the deals they make. In addition to this I can also be very childish.

Most certainly though I would not want one penny of mine in their account any longer than until 4pm tomorrow and that is only because I am aware that they might not have time to do the transfer today and can find excuses, whereas not doing it tomorrow would lead to me asking them if they are intending to permanently deprive me of my cash...

run away - if theyre bickering over tyres and brakes then god knows what other niggliy bumps and scratches have been left on it

Out of interest have you tried the "So come one boys, level with me, what's your problem, what's your price and are you finished dicking me about yet or do you fancy another go? Seriously, I want the car, you have the money, what is the problem?"

You need to know why they can't sell this car to you and what can be done to ensure that they can sell this car to you.

We're looking for a new car for the Mrs at the minute and are being vey picky about the spec and car we want. That said even if 'The God Car' turned up on our list at the right money and all was perfect I'd still walk at the hint of any dicking about of the magnitude you have had.

Maybe they know that and are very ham-fistedly trying to make an extra coin.

They sound like jokers. Get your money back and continue the search IMO.

This is the bottom line assuming you had what was agreed in writing prior to sending the £50k.
