Any better advice for what I am about to do?

At work recently I have had to attend a number of meetings at one of our offices that is at the other end of the country. I always attend the meetings with the same colleague and we always get a hire car through work and share the driving as it is at least 5 hours each way. Usually the cars are hired in my name with both of us as named drivers.

About 2 months ago my mate was driving along a dual carriageway, in good conditions with very little traffic around, when I spotted a camera van in a layby up ahead. I had no idea exactly what speed we were going but as my mate tends to drive a little on the fast side I said "Camera van" and pointed at the offending vehicle. He hit the brakes and once we had gone past I asked him how fast he had been going to which he replied "Fast, but I think it was down to 90 when we went past".

Now depending on how far away we were when he clocked us we could have been doing anything from 90 to about 120.

Yesterday a NIP landed on my desk at work detailing an offence that occured about 2 months ago.

As we have been regularly travelling this route and sharing the driving we do not know for certain who was driving at the time of the offence. However, as neither of us can recall ever seeing (and speeding past) a fixed or mobile camera on any other occasion we are both fairly sure that it is the incident described above.

Obviously I do not want to admit to an offence that I did not do but neither do I want to stitch up my mate so as I see it I have 3 options:

1 - Say it was me.
2 - Say it was my mate.
3 - Say I don't know who was driving so can they please send the photos.

1 - Definitely isn't going to happen.
3 - is my prefered option but if the photo clearly shows it was my mate (which is what we strongly suspect) then would we have been better off by just admitting as much in the first place? (i.e. option 2)

If the photo is inconclusive then is the penalty dropped or does one of us have to admit to it?

Having read numerous similar posts it seems as though option 3 is the route forward but are there any potential downsides to this or can anyone come up with any better ideas?

If you are not certain who the driver was, then ask for the photo.

I doubt it, the original would have gone to the hire company.

check the photo. If it's clearly your mate, nominate him. No problem, and saves you grief. If it isn't clear, then argue it. Be prepared to spend a day or two in court. If it's worth it to you, then go for it. Hows the bike test going?

Is it a hire car or company car,if its a company car i think the points will end up at the MD if the driver can't be ID.Not sure about a hire car

Its a hire car so unfortunately the MD won't be picking up the points.
