Help! Second hand dealer ripped me off
Discussion
I purchased a car on the 30th September in Edinburgh from a second hand dealership, drove the car down the road to Ayr.
The next day I notice that the tax is out, however I dont have the V5 as it was sent away a week before i picked the car up to put the private plate that is currently on the car onto retention (for previous owner) so I cannot drive the car!
I also noticed a musty smell coming from the car after an hour of driving it. The carpets from the front to the boot were pretty wet. I phoned the dealer about this & he said its because the carpets have been shampooed and it will dry out. However after drying the car out for 2 days it still smells pretty bad, after a bit of digging I found mold under the rear seat. I have cleaned the mold with a mix of bleach & water, & removed the carpet and gave a good scrub & washed in the washing machine.
I have also gave the car a intensive clean top to bottom, but the smell still lingers. As I said earlier its a musky smell.
Moisture is still present in the boot, only a few drops but enough to notice. Ive used 3 dehumidifer ball things from homebase, 1 caravan dehumidifer from halfords, along with two bags of cat litter. The carpets are still slightly damp.
I have also had a warning light come on when I was pulling onto my driveway. Having a poke about under the bonnet ive found the intake pipe has a a big split as well.
I feel like a total idiot buying this car, I have really let my guard down, however I am wanting to return the car as if there is mold under the carpets then that is a serious health risk, im really unhappy with the purchase.
I have owned the car for 6 days, I put a deposit down on it 13 days ago.
how should i go about this? I am wanting my money back as I dont see it as fit for purpose. What are my rights? Any legal documentation I can print off? Please someone help!
P.S the car is a 2006 320d MSport

I'm afraid I can't see that damp carpets equals unfit for purpose, unpleasant though it is. A warning light (which one?) and a split hose doesn't either. In any case the dealer would have to be given the opportunity to rectify the issue.
It might be something as simple as a blocked drain hose especially if the car has a sunroof. Have you approached the dealer to see if they will look at diagnosing the issue? Did they give you a warranty?

So you bought a car that had no logbook. How is that anyone elses fault?
Also you do know you don't get tax with a car purchase anymore anyway?
You say you have traced the leak to the boot, so you may have to buy a new seal, put a bit of silicone somewhere!
You need a new rubber intake pipe that may cost a few quid...ok let be fair £30 max
Christ I would take it back right now, he should buy you a new car as compensation. Don't settle for anything less.

The carpets were damp, I pointed this out when I picked up the car, the dealer said they had just been shampooed & will dry out very soon. I took his word on this.
There hasn't been any floods, however looking at previous MOT's, the car has only done 1500 miles in the last year, so im presuming its been sitting for a while?

I had my living room carpets shampoo'd a few months ago. Within a few days I noticed a really musty smell. After about a week the whole room stank of what smelled like heavy mould. I was convinced the whole carpet was f
ked.
I kept the windows open, used a hairdrier on the remaining damp parts, and covered the carpet in bicarb of soda for a few days. He presto, smell gone.
Go buy some bicarb, get a hair dryer, and keep the windows open where possible.

no tax? thank the government.
no v5? well thats all on you im afraid.if you have the little green bit you can still pay your tax in a post office (if its got mot and valid insurance on their database)not sure if they accept the paper docs anymore.dont think you can move a plate without the v5 in your name but im not sure.
wet carpets in the boot? how old is the car?
not sure bleach is good to use anywhere in a car not even in scotland.
as for the split hose do you think it was split when you bought it or could it have split on the drive home?

1500 miles In a year For a Bmw diesel does not sound very likely. There hasn't been any floods, however looking at previous MOT's, the car has only done 1500 miles in the last year, so im presuming its been sitting for a while?
In fact highly un likely.
Check if It's been clocked.
Or maybe sitting in a salvage yard for months waiting to be cat C' or D'd.
The key issue here is the wet and mouldy carpets, whether the dealer knew about it and whether he tried to conceal knowledge of it.
A car interior is supposed to be dry. It is only wet because of a failure of something such as a seal or a drain, or if it has been shampooed. You make up your own mind whether you believe the dealer but his 'it's been shampooed' explanation suggests he acknowledges it is wet inside and that's potentially his excuse. Mould would suggest this is not just a recent shampooing.
Don't forget the corrosion issues a wet interior can cause, whether to the metal floor or to electronic circuits.
