Hi everyone,

I've just sold my car through a dealer in return for an agreed commission amount but i don't trust that what he says he sold it for is really the case, and he's avoiding giving me any documentation to prove otherwise!

Has anyone else been in this situation? What powers do you have? Other than turning up and blocking his forecourt!

- are you entitled to new owner details?
- are you entitled to obtain confirmation from the finance provider as to the selling price?
- DVLA?!
- Police?!
- Trading standards?!

Once I get to the bottom of it I'm happy to let everyone know what dealer to avoid!

Surely you made a signed agreement with him?

In that agreement, I should imagine there is a stipulation that the sale price is determined by proof being a copy of the invoice to the new buyer?

Without an agreement, you've little hope but you can ask to see said invoice/receipt.

An agreed commission amount you say? so, you had agreed, he has paid, what has it got to do with you now?
was there a trade in against your car?.... are you remaining liable for any refurb, warranty costs he might incur for the next few months?
When I do this, I usually agree a price to get back for the customer (you) rather than a percentage. as far as I see, its nothing to do with you.

Written Agreement?

Percentage or flat amount to you and he keeps the "gravy"?

Bloody hell, I hope he has made more than £500 for retailing a £30k car....... after his costs he is left with nowt.

Let it go. At a mere £2k under your reserve coming up to a slow time of year for used cars, he's still done you a favour. It's unlikely that you would have achieved £28k on selling from your driveway. A sale is a sale, spend your efforts buying a new car.

So you agreed that you would take £28k and give him a drink for the trouble.

You've had your £28k. What's the issue? Do you think he's lied to you about what he sold it for an trousered the difference?


(1) He's (as below) done you a favour shifting it at a bad time of year
(2) You got more than you would have privately
(3) You've been paid.

Yeah, this is the point really.

OP is happy with £28k if he's not been lied to, but not happy with £28k if the dealer sold it for £29k and trousered the £1k.

I think the OP should decide if he's happy with £28k, regardless of backstory. If he wasn't happy with £28k he should have rejected that offer. If he was, then it doesn't really matter about what the dealer made does it?

My point is that even if the dealer was "trying it on" by claiming to have a low ball offer, the OP could have turned it down and avoided any chance of the dealer skimming more off the top by not shifting from his £30k price.

How do we know the dealer didn't get £5000 plus something else traded in..then the first car broke down and cost £xxx to fix...etc etc...

answer is no one knows, your deal is done...I suspect you are being greedy.... next time sell it yourself.

My point being the £28k is now in the seller's pocket. What the dealer sold it for is neither here nor there apart from a displaced sense of disgruntlement from the seller. The seller didn't have to accept the £28k and could have pulled out of the deal at any time.

Exactly.

He offered you £28k. You accepted £28K.

If he pulled your pants down then he's a bit naughty, but perhaps you could have insisted on being there when the deal was closed given it was your car.

Move on.

Totally agree.

However, given your original deal was that the dealer received nothing except commission on finance (unless he sold for more than £30k) - did you really think he was ever going to sell it for cash?

TBH, I don't think the dealer sold the OP's car for him.

I think he bought the OP's car and then sold it to his customer, having already agreed his sale price and re-negotiated his purchase price.

Wow yeah! 28k at 0.18% interest for a year is umm... 8 quid for 2 months! Robbing bd!

You agreed a deal, you got your money, the agreement has been honoured. If you knew more than the dealer about selling cars you'd have sold it yourself. You didn't so move on.

fk me. Seller in sells car and gets paid for it but begrudges a business making money shocker.

Are you really that naive to think that a business isn't going to maximise its profits? st, if I got what I wanted, I couldn't care less what the trader sold it for, but then I'm well adjusted.
