If someone casuees an accident on a road be it an A road or motorway and you are held up for hours on end waiting for the authorities to clear up the mess can you sue the person ( or their insurers ) for any loss of income due to the fact that you've been sat in your car instead of at work earning?

You could try, and you'd probably succeed, but it would cost you far more than you lost by being stuck in the jam. You're not american by any chance are you?

I was held up for five hours the other morning after some muppet thought he could handle his car at speed in the damp on a bendy road. The poor sod stuffed it under a truck going in the opposite direction. He and his passenger died in the inferno that followed. I lost five hours and missed neighbours (big deal), they lost everything.
How can you even think of sueing them?

Lawyers in the US sit around and dream of this stuff.
We don't need you giving them ideas for the ROW.
Check the definition of "accident" in the dictionary.
If you were a passenger in your friends car at a trackday and he threw the car into a tyre wall causing you some form of physical or mental discomfort, would you sue him as well?

The answer is "No", for two reasons:
(1) Public Policy
(2) Too remote

It's rarely the accident that holds you up rather the Police et al while the accident is dealt with and investigated.
You could try sueing the Police and see how far you get.
