Quick hypothetical question.

The mobile phone laws cover holding a mobile phone.

So in theory if I am talking to someone on my wire handsfree kit with the phone sitting on my lap or in the door compartment - ie no fixed holder that it could be in, and the police see me talking (on the wire), can they do me as I would have theoretically have had to have picked up the phone to dial the number in the first place?

I still want a mobile phone holder that is actually a fake arm/hand holding the phone to my ear

Theoretically, I think that's right.....but whether they'd bother to pull you just to check that your phone is fixed somewhere is debatable. I've got a blue tooth headset, and my phone just sits in a pocket on the centre console........they probably look to see if you've got a phone on the side of your face, and if not then I would have thought they'd leave you alone.

Having said that, I suppose that it wouldn't look good in the event of an accident if the phone was shown to not be fixed down and you were making a call at the time!!

You're right...if you're using a handsfree kit, I would suggest that no BiB will stop you to see if it's fixed etc.

There are enough people breaking the law by using hand held ones to deal with, before peesing about stopping people who have taken the trouble to buy/use handsfree kits.

In response to your last paragraph, in the event of a serious/fatal RTC, the mobile phone of the driver will be seized by police to see whether it was in use at the time of the collision.

Hello Gary, and everyone,

Good grief, are we really saying that a driver is at risk of receiving a fixed penalty every time he is seen driving with less than two hands on the steering wheel - except for the need to make gear changes?

I hope we're not going to have unnecessary enforcement of that one - at least until somebody nicks PC Martin Northam for an extremely casual and laid back steering technique as seen on TV.

Besides.....my friend in that force states MN isn't trafpol anymore...go onto better things...

My phone has a loudspeaker/handsfree speaker kit built in, but no cradle etc to hold it.

Does that mean that if I take or make calls while driving, with the phone on the dash or door pocket that I could be fined??

If you are required to press a button to answer a call...yes...

In reality....you're not likely to be stopped.

On the TV sequence Martin was driving a traffic car in a built up area. He was talking to his front seat passenger, and initially holding the steering wheel at about the 3 o'clock position with his right hand. His left hand was waving about in the air as he explained something. Then he fiddled about with something behind the gear lever area, at the same time dropping his right hand from the 3 o'clock position to about 5 o'clock, thereby not actually holding the wheel with either hand for a period of time.

I have nothing against casual or laid back steering, but that amounted to improper control just as much as it might have done with any normal driver.

I just want to know when these laws apply to everyone, ie police using two way communication, letting go of steering wheel, etc.

Can you remember the guy who was prosecuted for drinking whilst stationary at traffic lights?
