Hi

Thankfully not had one of these for a very long time and couldn't find the details of how things work these days.

Alleged offence on the 5 Nov - so it's within 14 days.
But there's no photo of the offence or showing the car or who was driving at the time. Honestly can't remember who was driving at that point.
Just says the allegation can be supported by technical and photographic evidence.

Do they not sent out photos of the "offence" anymore ?

FYI It's for 53 in a 40 zone - Watford Way junc with Station Road North London

They are under no obligation to send photos out with the NIP / s.172, never have been.

Straightforward questions - why can't you remember who was driving the car a few days ago, and what have you done to try and ascertain who was driving ?

You are not entitled to it unless you go to court but:

- some forces send it on request
- some forces send a password and login details - to view it online.
- some forces will not disclose it. (E.g. North Yorkshire)

Requesting the photo does not put on hold the obligation for you to identify the driver within the timeframe specified. A photo of the back of your car probably won't help identify the driver anyway.

Check iPhone frequent locations for the date in question?

If your area has adopted the ACPO guidelines then you're within the threshold for a speed awareness course.

And then if you're going to continue with the "I don't know who was driving" then be prepared to tell that to a bench of magistrates who will ask you what you have done to try and identify the driver etc.
Convince them and you're laughing, otherwise you're looking at 6pts for failure to furnish.

OK - thanks for clarifying.
Seems odd that the can give you a ticket without providing any evidence.

Thanks all.

They are asking for the ID of the driver at the moment; the evidence they have will be shown in court should the 'speeding' get that far (and at this speed this is extremely unlikely as long as the driver is identified now).

You could, however, write a polite letter asking to see a photograph to help you to identify the driver smile - but do NOT use the word "evidence" or ask for calibration certificates etc as they will blank you wink . If it was a Gatso then you'll get a pic of the car from the rear but it wil have the speed on (there's yer evidence that the vehicle was speeding wink ).

Failure to ID the driver will lead to a court appearance, a fine around £600 plus other costs, 6 points and an MS90 conviction code on your licence which will make any motor insurance much more expensive for the next 5 years (in other words, the stakes are high...).

Cheers - pretty certain it was me but don't remember being flashed. I'll probably just say it was myself and wait to see what happens.

Also, if it was a fixed camera somewhere near your location you could visit the scene and see if the secondary corroboration marks on the road are present.
