Girlfriend parked in a local Co-Op in a small commercial village. She had a look around some adjoining shops, met a friend for a coffee, then did her usual weekly shop at said Co-Op. Free parking was for 1hr 30mins. She was snapped leaving the car park immediately following her shop, but had parked there for a total of 3 hours. Parking charge notice received today. What is the current legal situation with these extortionist's? I've heard they do now go to court on unpaid or ignored "fines". She did legitimately shop at Co-Op, as she has done a couple of times a week for years, but the ParkingEye appeal process seems to be a scam and doesn't really exist. Can anybody update please with accurate info? Thank you in advance.

1) Write to Co-Op mentioning loyal customer etc (include receipt for the day's shopping). If Parking Eye are working on the Co-Op's behalf, Co-op may be able to get it cancelled.

2) Soft appeal to Parking Eye. More than likely will be rejected. If so, ensure they give a POPLA code.

3) Appeal to POPLA (plenty of threads on MSE or Pepipoo will aid you in planning a defence).

Do your research properly and write a decent letter to POPLA citing the correct regulations and you should win.

You can appeal the ticket on their website and it's not a scam. They cancelled each one of mine on appeal when I attached proof of spending money (Starbucks). They refused one and issued a POPLA ref, but no idea why. Contacted the business that owned that Starbucks and they got Parking Eye to cancel.

No help, but I'm amused that you describe Parking Eye as extortionists and scammers when your girlfriend parks for 3 hours in a 1hr 30min car park, goes off shopping & coffeeing elsewhere then cry foul when she gets a ticket.scratchchin

The way I read it the adjoining shops and coffee place share a car park with the Co-Op and it is the site that uses Parking Eye. So it depends...

You can appeal it to both Parking Eye and POPLA, but there is also a service who will appeal it for you, but they charge £15 for doing so IIRC. This kinda tells you that they must win a hell of a lot of appeals!

Maybe because the law somewhere states that they can only legitimately charge the 50p per hour excess when you've actually shopped there. You're right, you're no help at all and you're sort of suggesting that my girlfriend is the scammer which is rude. I asked for help, not smart arse comments.

Edited to add. The village in question is surrounded by a number of neighbouring, fairly high density residential areas, but the village has no adequate public parking to service the traders within the village. It is an ancient village with only the Co-Op car park, a golf club car park and several small pub car parks. Streets are all yellow lined or resident permit only. The choices are therefore seriously limited. Maybe she should have driven out after an hour and a half, done a u-turn or congested the roundabout and parked up again. Because that would have been cheaper, safer and better for the environment. We are not talking about the law here. No "law" has been broken. This is a private property matter.

Register on Pepipoo.com.
Follow their advice to the letter.
Do not contact PE until you have seen what pepipoo have to say
If all goes to plan , and in 99% of caes it will. you will cost PE £27.00 to cancel the ticket

good posters on there are Gan, hcandersen, and Schoolrunmum. Just look for ones with a mega amount of posts.

Or you can pay PE..... your choice

Similar situation locally in a car park run by Asda, but with a good few other shops on site, including an Asda cafe. I've had one speculative invoice from Asda lot claiming I parked for about 5 hours. Photo shows me entering at about 10.30 and leaving at 15.30. In the mean time, I'd exited from another exit and re entered via the entrance I used earlier in day to shop at another store in the complex. I took it to customer services ,where the lady was not helpful ,till I asked for a manager to explain how I could enter twice, but be recorded only once. My suggestion was scam by parking company or faulty equipment and failing a manager explanation I would let local papers have details. I then got next level of customer service making a fuss, ticket was taken for cancellation ,and I got an apology. Few days later ,ASDA had their worst nightmare- someone had spent time in the cafe, shopped in store and browsed in the other shops, totalling over two hours. She'd been sent a ticket. And she had decided to write to local paper. Last reply in paper was to (humbly) ask customer to visit store with ticket where it would be cancelled.
Personally ,I'd bypass parking Eye, and ask Co-op customer services for help.

We've got many receipts (including that particular visit) showing a not insignificant monthly spend. I think the Co-Op customer service is our first port of call. Seems the most obvious course and the one least likely to be arduous and combative. Thank you to all who have contributed, (well nearly all).

If it's anything like my local Co-Op's, you'll spend most of that time queuing up at he checkout.

Your girlfriend is the reason why they exist.

You're right that the Co-op may well cancel for PR, however the time limit is there to help more shoppers get a spending opportunity. It isn't your girlfriend's personal car park.
