Pushy compensation claims
Discussion
Someone hit my car when stationary at a petrol station earlier in the year - some old duffer not paying attention, took some paint off, sorted through his insurance.
I get a call tonight saying apparently the "case cannot be closed" as the other driver Michael's (he knew his full name) insurance company have allowed my £1000 for any discomfort I have felt...
Now I know all about false whiplash claims etc, but I merely stated on the phone that it was at circa 10mph he hit me, I didn't feel a thing etc, so no, I will not be claiming, but the guy on the phone just kept pushing and pushing - saying "it was so long ago and your word of mouth it doesn't matter really it's your money you might as well claim it, cheque be in the post in January for £1000" etc. And was REALLY quite pushy - so I can see how people claim all the time for this when it's not really needed! So easy for me to just say "yes" and get free money.
I'm guessing he'll get a big fat cut of the money himself if I agree - which is why he is so pushy? I thought there were laws around false compensation claims and doctors notes etc needed for whiplash claims, or is the whole thing still open to be taken advantage of?

Damage limitation
They want you to take the money so that you don't make a injury claim in however many months/years. I assume taking the money would mean you can't make any future injury claims.
They're being pushy because they want a guarantee that you won't be claiming for injuries which you are free to do for quite a long time in the future.

Interesting - hadn't though of this. A way of silencing me by handing me £1000 to potentially save more in the future? They want you to take the money so that you don't make a injury claim in however many months/years. I assume taking the money would mean you can't make any future injury claims.

I guess this is also what it boils down to. He just wanted to push so hard on the phone and made it sound so easy.Riknos said:
