Overpayment

I found out my previous employer had overpaid me. So I informed them and said I am happy to pay back what I have received(i.e. the amount in my account), they were furious and said no you have to pay the gross amount! I am not sure if that makes sense as I have already paid the NI and tax and would be giving back more then I had.

I called HMRC they said it is up to the employer to sort out the tax. I am having trouble getting an explanation from the companies HR department as they are based in Budapest.

Any experience on how it should be? ACAS said they cant get involved as it's been going on for a long time and I am no longer an employee.

You should repay the net amount. The ex-employer should do an adjustment with HMRC.

Quite amazing! They are trying to make you pay for their mistake without having to deal with it themselves!

Tel them to go stuff themselves. Pay the net amount back. Your company has to sort the rest out with HMRC.

What is interesting I received an email from them saying if I do not pay back the full amount the debt will be passed on to a debt collector agency which may affect my credit rating.

This is quite insulting considering I have called them to make them aware of the error and said that I want to pay back what I have received. The complication has come from HR in Budapest wanting the whole gross amount returned.

Will speak to them again on Monday or just pay the net amount back.

They can't 'pass the debt on' because they have to prove the debt first.

Are you really sure you've been over paid, where you due any bonuses, holiday or notice pay?

If you are sure, park the money in a saving account until they see sense.

Their threats against your credit rating and using a debt collection agency are groundless.
