A mate of mine has a 2012 Scirocco he bought at about a year old, it has a nice OEM VW Hard Drive stereo with an LCD display which has stopped working and reverted to German language, he put it into the dealers to look at the fault and they are saying this stereo is not the one the car was originally fitted with.

So perhaps the original owner had it fitted by the supplying dealers or got it fitted independently ? anyway, the dealers looking at it aren't the ones who supplied it to my mate, they sold it with a warranty and he bought it partly due to having this audio fitted, the dealers looking at it are saying they may have to fit the same as it was supplied with ! they said they will speak to the supplying dealers but he may have to accept the cheaper unit.

I said for him not to accept that, he bought it with that one, he paid accordingly and they supplied it as such, how that unit made it into the car is immaterial.

So, what should he quote in terms of consumer legislation, can they actually do that, the original unit is pretty rubbish in comparison ?

A retro-fit wouldn't be covered under warranty. I can't see how you'd sensibly expect it to be?

If he didn't know it was a retro-fit then he needs to speak to the supplying dealer and see what they say.

He has a grievance with the supplying dealer in that case, not any other dealer and/or VW UK because the "new car warranty" would only cover the original parts.

Maybe check the build codes for the car and see what it was actually supplied with or contact the original supplying dealer and ask if it was fitted by them?

Or learn German, it's really not that difficult for an English speakerbiggrin.

If it is OEM VW, was supplied as an accessory, and fitted at Pdi, then it should carry whatever warranty the car has - Or at least that what other manufacturers do.

If it was supplied after Pdi, but was supplied/fitted by a VW dealer, then it should have whatever warranty they offer on that type of accessory

Surely he bought the car with a VW warranty, the warranty was on the car as it is now, they sold it with this as a feature/benefit so surely it has to work ?

They didn't mention it was retro fitted, the car was only a year old and cost 18 plus grand, it was reasonable to expect it was Original Equipment, it was an option on that car, its not some Ripspeed headunit.

He is waiting for VW and the supplying dealer to contact him.

Has he actually read the warranty???????

Unless non-standard bits are excluded the warranty is on the car as sold used, not the car as originally built new.

If he's relying on SOGA than the ground is much weaker. Does the car still work as a car? Yes. Is it still fit for use as a car? Yes.

If he's trying to rely solely on the manufacturer's original 3-year warranty then that WILL be on the car as originally built and sold new, not as subsequently modified.
