So here it is. Got myself an 06 Golf GT TDI 4MOTION from a dealers in late October. I sorned it and put it in garage til the weekend past. When taking it out I noticed small drop of oil on floor but nothing major. I took it for a 50mile round trip and when I was on way back it was sounding rough(gearbox). I took it to my mechanic pal and he took quick spin. Without even looking he said it is gearbox, take it back to dealer. I have since took it back and left it with their mechanic. Dealer phoned and said it was a failed driveshaft seal. My question is do I pay for this repair or do I claim it was faulty all along? Also if gearbox was out of oil or low on it, will this not have caused damage? When my mate popped hood you could smell burning gearbox oil.

Old car with an oil drip four months after purchase - I'd say you'll need to talk to the seller very politely indeed. Hope you can agree something suitable.

The car is 8 years old, these seals do need replacing from time to time. They could go at any time so the garage doesn't have to do anything. I expect the leak is quite minor and the gearbox will be fine, but they will know when they check.

I paid £4000 for it. Has only done 50 miles. He told me it had just been fully serviced on day I collected it. Sale of Goods Act not cover things like this?

It was bought less than 3 months ago. And was Sorned after taking delivery of it. 1 days driving and this issue arose.

Depends on how the leak is caused. If it is a fault with the servicing that was said to be done, then yes. BUT in the first 6 months after sale it is up to the suppler to prove otherwise, after that it is up to you, which is quite hard, so you are in luck at this time.

Well just got car back from dealer. He said a driveshaft seal had gone which has now been replaced. Told me it would take a couple of days for noise to go out of gearbox. Total BS. I have since took car to 2 other mechanic pals. Both say gearbox is on way out. Time to call dealer and finance company.
