Mate ordered an item from an online shop via E bay. When it arrived there were two of them and he's only been invoiced for one.

Dilemma for myself is I was also going to buy one, dependant on how his performed but, he has offered me the duplicate at half price (so we both pay half the retail cost) after a week, if there is no come back from the retailer. I've told him I'm not going to accept it and he should get in touch with the shop and explain their cock up, he may even get a little sweeter for being honest but, he said if I didn't want it he knows someone else.

Could he be charged again if they uncover their mistake and how much trouble will he be in if they find out, after he's sold it?

Haha, I don't know, maybe, if you think he is. The point is the driver should not have thrown a package over the fence, especially without trying to deliver it first at the front door...
It's quite simple , your neighbour is a thief and you seem to condone his actions.

Obviously the parcel was in the porch because as you said he got a replacement and sold the other.
Controversial,, but Why doesn't your neighbour just say it didn't arrive and say don't bother with another then you can both have a free one smilewobble

Or he could be honest and tell the company and they may just give it him idea

Don't understand your first comment unless you glanced at my thread without reading it properlyrolleyes I'm really trying to find out how much grief he could get, so I can convince him to do the right thing, hence posting in Speed Plod etc.

Unless the retailer can prove they sent 2 and your friends invoice says 2 then there isn't really much that can be done.
Are we talking a high value item? I imagine unless it was worth a high amount the retailer would just write it off.
Whether your friend wants to do the right thing is another story, but unless the retailer arranges all return costs I wouldn't be rushing around.

There wont be any come-back. It's ebay.

In my experience this has happened a few times, albeit low value items (£1-2, cables and such).

The same way with lower value items, if they turn up damaged, sellers just tend to send another and don't ask for return of the broken/damaged item as it just isn't worth the postage costs/hassle.

He paid £135 for it, not sure I should mention this though as he's already leaning towards keeping it. I suppose at the end of the day it's his decision and he's a big boy.

What he should do is contact the seller, just the once.
Tell him he has received two items when he only ordered and paid for one and the seller has 30 days to arrange collection (at buyers convenience). Then, leave it at that.
If nothing happens within 30 days, cool, you've got a freebie. Otherwise, at no real inconveninece, the duplicate item can go back to where it came from.
However it is pretty obvious what you and your mate want to do - so in all honesty - Worst "I've got an extra item from EBay which I'm not paying for" thread ever.

My mum ordered some Levi's from John Lewis before Christmas for my brother. When the package arrived there were the jeans she ordered and another pair one size larger.
These were £70 jeans, so she did as I suggested - emailed, told them and said they had 30 days to sort everything out.
Within 24hrs she had a reply thanking her for informing them of the mistake and as a gesture, if the jeans were of any use she could keep them or pass them on to someone who could use them - so I got a pair too.

I once ordered a litre of expensive synthetic oil (as a top-up between changes). A couple of days later, TEN litres turned up - someone clearly mis-read the order and it got processed.

I called the company - they were incredibly appreciative and arranged for collection of the ten litres AND they sent me my one-litre bottle free of charge.

Double-win - I got the oil I needed at no cost AND I had a huge feel-good factor at having done the right thing.

To the OP - just think if you were running a small company - struggling to turn a profit in economic hard times - you make a mistake by double-sending an item, but the customer is honest enough to tell you. Depending on the value, you'd probably just thank them and tell them to keep it, or arrange to have it collected and send them a little something for their trouble. Either way, you'd be genuinely thankful that there are still some honest customers out there.

On the other hand, I've just wasted three minutes of my life, and you were always going to keep the extra item, and you hoped that enough fellow PH'ers would agree to make you feel like you weren't a crook.

Edit - OP's mate, not the OP....

Won't speak to him until this evening but as I've already mentioned it's now his choice. My thinking was more in line with replies saying, he will be prosecuted, or billed again etc so I could scare him into doing the right thing.

Once again, NO I won't be receiving the excess item but, can see how it comes across as abovefrown

I think that if you do nothing and keep the extra item they will not notice and you will not hear from them again.

About 10 years ago I was living in Bristol and had to work in Yeovil for 6 months and was given a company flat for the duration and one of the people I notified was my car insurance company. While there I part exchanged my car for a new car and as it was a lot more powerful than my old car my insurance company would not insure me so had to arrange new insurance My old insurance company said they would refund me my remaining insurance that was about £270 so I asked them to send the cheque to my Yeovil address.A month later I went home to Bristol for the weekend and they had also sent me a cheque for £270 there as well so I cashed them both and have never heard from them.

We generally get ripped off in various ways and if a present comes your way why not keep it.

Had this issue once or twice, last time was when I ordered a laptop bag online. Three weeks went by and it didn't arrive, so I emailed the company and asked them what was going on. The chap replied saying they'd already sent one out but understood I was waiting and had re-sent the item and upgraded it to 24hr recorded delivery.

I was at work when the item was delivered so I got one of those "sorry we missed you cards". Went to the post office to pick it up the next day and the guy behind the counter gave me two identical packages, one with a dispatch date of just over three weeks ago. Obviously the original one had reached the PO but for whatever reason it and/or the sorry card never made it to my house.

Got in touch with the company and said I had two cases, would they like one back. At first they were happy for me to keep both, but given the bag was a bit irregular (it was massive and designed to carry two large laptops) I didn't really need the second one. I thanked them for the gesture but said I really didn't need it and it would be dishonest of me to sell the surplus case and deny them a potential sale. I sent the unopened case back, they paid the postage. Smiles all round.

FWIW the case was about £80 so of reasonable value. If it was a £5 jobbie I probably wouldn't have bothered and just freecycled the extra.
