Hi guys, after a bit of advice.

I ordered a multigym, from a well known high street sports shops website, on the 01/01/15. The delivery estimation was 3-5 days.

The order was dispatched on roughly the 4th, and still has not been delivered. The tracking on the 'couriers' website shows it being at the delivery depot, as of the 9th. I say 'couriers' because I have never heard of them, and they have absolutely abysmal online reviews.

I have contacted both the senders and the couriers, upwards of 50 times, via phone, email, twitter etc, but I have not even been able to speak to the couriers, and the senders have been ignoring me as of Friday. Understandably, I am now absolutely fed up with this, the order isn't moving from the courier and the senders are blatantly ignoring me.

Is this the sort of situation the chargeback function was introduced for? I paid for it via AMEX credit card, if this is the case what is the process? I have no hope of this order actually arriving, so would like my money back to buy another.

Any advice would be greatly appreciated.

Cheers, Clarkey

I think you can only charge back stuff of £100+ but don't quote me on that one. You need to phone your card provider.

The order came to 199.78 ish, so should be within the price constraints, I just didn't know if there was a time scale I had to follow or anything like that.

Cheers!

If you're that pissed off, can't you cancel the order under the consumer contract regulations?

I don't think so, as its been dispatched, worth looking into though so I will have a look!

Been in touch with the bank, they said it has to be 30 days before they will look into it frown

Cheers

You have 14 days from receipt of the goods to cancel for any reason. I don't see why you cannot cancel prior to receipt?

Thats true, would have to be able to get in touch with the senders first though, the phoneline has been down for 2 years and they won't respond to any other form of contact I have tried, its the company that is owned by the Newcastle United chairmain if anyone can help with contacting?

Cheers

I would send a brief email to whatever address is listed for their customer services telling them the goods have not yet been delivered and you are exercising your right to cancel the order as per The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. They should then reimburse you within 14 days (to include basic shipping costs if you paid for those).

Impressed by the fact you are still interested in your News Years resolutions!

Most people who ordered gyms and gym membership and got to use it straight away would have given up by now.

Maybe a blessing in disguise....!?

Is it Yodel by chance? Delivering that is.

Surprisingly its not Yodel, presumably because its a two man delivery, which I'm not sure that yodel do. The courier is XDP, never heard of them and will certainly never use them again. They have a customer service number which rings, before asking to leave name and number to which they never respond, a customer service email which never is responded to, and a depot email, also which is never responded to. Yodel delivered the magazine that I also ordered at the time, it was picked up on a Sunday, and delivered to me the Monday lunchtime, I was rather impressed, but surprised they had couriered a magazine to me!

The senders have replied to my tweet, simply stating that the delivery team will be in touch to arrange delivery, and that they have had a slight delay on the two man deliveries. I have been told nothing regarding this what so ever, so they will be receiving a rather snotty tweet back in the morning!

Not actually a resolution to be honest, more of a being fed up of being small and gaining a decent overtime payment!

I had something eventually delivered by XPD last week. It took four days from their first text to tell me it was on the way that afternoon to it actually arriving, damaged. The driver was climbing back into his van as I opened the door and was away before I saw the damage.

Like you I spent a lot of effort trying to contact XPD to no avail.

The seller then sent replacement parts via Yodel, badly packed and arrived damaged, so sent some more, just as badly packed which arrived damaged. I don't blame Yodel for the damage, delicate things need wrapping, but it has soured my online shopping experience.

I don't think I'd ever order anything that was delivered by XPD again.

Well, I had an email from sportsdirect yesterday, stating that it should be delivered by tomorrow. I hold no hope of that at all. It's still sat at the delivery depot today, no surprises there!
