Say for instance my car had been damaged in a car park by another car. The car park is covered by CCTV but they won't give me any details from it as they only give out details to the police. I wouldn't want to go through insurance as the non fault claim would increase my premium. Would there be any way of getting the details of the car that damaged mine from the police and get some kind of compensation from the other driver without having to involve insurance?

Will the police give me the reg though? Or will they force me to give it to my insurance company and pursue the claim that way?

Write to the operator of the cctv with the date and time/ description etc. Stating that you're requesting the cctv under the Data Protection Act. Could be a small charge but they may give it you if you feature on it.

And they only have to give you the bit that identifies *you* (because DPA is about personal data) and can opt out if it's too costly to redact the personal data of anyone else in the same bit of video because disclosure would violate their duty to protect the data of the other parties.

I think you will find that the DPA is exactly as it says "Protection" therefore you can't have it.

Are you thinking of the Freedom of Information Act? If you are then no luck there I'm afraid.

If it's a private car park, it isn't an RTC. The police will be unable to assist.

Surely if you go to the police and they get the reg. to give to your insurance company for a claim, your insurance company would claim off the offenders insurance and this would not affect your no-claims as it would not be your fault?

Yeh I know if only you on feature on it youre entitled to it. But he may get lucky and get given an extended version, although number plates may be blurred. I recieved cctv and it had almost an additonal five minutes on it.
