So i recently went to view a car.

Before leaving we phones to enquire about this specific used car.

He speaks to the dealer, all checks out, colour is confirmed, it's the spec he wants etc, FSH etc.

Anyway, we get there & its a different colour to the ad, at this point it instantly put us off as we wanted that specific colour & wouldn't of travelled hundreds of miles to view it had he known it was the other colour, dealer said that if it was not as described he would refund the deposit on the phone.

Dealer would, once we were on site, not refund the deposit & has subsequently changed the colour to the correct colour on the ad, thankfully i have timed screenshots of the before & after ad.

Question here is, do you think we will get the deposit back via chargeback with the CC company?

I'd take it to Trading standards, and show them the evidence, And then contact the dealer that you want your deposit back, drop the bombshell that you've spoken to Trading standards and will be pushing the case at small claims court if he doesn't refund it.

Probably won't take long before he quickly refunds it.

It's worth a shot at least. Make back-ups of the data you have, even print it out.

Send a registered letter containing both the old ad and new ad with proof of deposit and politely ask for the deposit to be refunded within 7 days.
if deposit is not returned you will take measures to recover the deposit.

may be a good idea to move this to SP&L

As he didn't even remove the advert I find it hard to believe he has any claim to your deposit at all (even if the car was as described).

I'd report to trading standards with the screenshots of the car being advertised as a different colour.

It shouldn't be too hard to get your money back, hopefully.

This, in all likelihood the cc company will reverse it there and then, worse case they may ask for your "evidance" 1st. Either way the dealer is unlikely to waste time challenging it
