Hi Guys,
Advise needed. Bought a BMW M5 2012 from Spires Dealership about a month ago. When I saw the AD the interior trim was described as being Honey light Bamboo trim but the picture in the AD was Piano Black. I emailed the sales guy to enquire why the trim was a different colour from the picture.
He replied saying the trim was changed because the wood was horrible. To be honest I wouldn't have bought the car with the wood trim anyway. So went ahead and bought the car. Now this is where the problems started.
1. The trim wasn't changed, instead it was wrapped in piano black
2. The Stop and start system never worked even after driving 500 miles in it
3. The interior switch for the hazard light and door lock never worked
4. The brakes squealed really bad
5. The air con was blowing hot air.
After repeated emails and call to the dealership they car was booked in to be repaired. No loan car was provided so had to get a 2 hour train back home and another train to collect the car.
Car picked up last week and most issues sorted but still the stop start not working properly. Anyway the main issue for me is the interior trim being wrapped instead of being replaced like they said.
When I raised this with them, they came back saying that they have phone recording saying I knew about the wrap. I know for a fact they weren't any phone conversation with the sales guy telling me before I bought the car that it was wrapped. In fact I have an email from me to him asking him why the trim is different and whether it's been changed or not and a reply from him saying it was "changed". Never did he mention "wrap" to me.
What I want to know is what can I do to rectify this issue with them? I have asked for another yr warranty and they said no. Can BMW legally record conversation without notifying the seller when it relates to just a sales call?

They can't record the call and use it is a court of law without telling it is being recorded (most say it is for training purposes, etc as a std patter at the start), however you taking them to court for doing it and not telling you might be fruitless.
If they have the recording, it might actually help you rather than them?
