We bought a second hand E320 CDI Estate from a private seller in February. Over the next few weeks it kept going into limp mode. We took it to our local garage (£200) and they couldn't fix it so took it to the Mercedes garage where it had had all its previous services. We found out that the previous owner had had a test done in January where they found fault with the turbo boost. He clearly sold us the car knowing the turbo needed replacing at a cost of £2,300. I have the report from the garage dated 2/1/15 which he failed to give us. Is there anything I can do?
Private seller = sold as seen. You have absolutely no come back, I'm afraid. You can try, however, as he may not be clear on the law. Also, does he often have cars up for sale? (Same background or road for a lot of cars in your area.) He may be trading under the guise of a private seller so you may have somewhere to go with this.
Did you get a receipt from the seller with SOLD AS SEEN and signed by you both?
I beleive this statement with a signature is crucial legally.
Have you got a warranty on your car.
Sorry to hear of the problem you've encountered. Seems very expensive for a turbo, i'd hunt around for alternatives, like trying a host of Merc Indy's. Refurbished turbo's + fitting should be a third of the Main Steelers?

I would visit him with the evidence and see whether he will give you your money back. It might help if you took your two weightlifter brothers along with you too. If that didn't work, if he's a sole trader there may be other ways to influence him that his customers might want a trusted advisor of theirs to be honourable?

Is it hesitating when you accelerate as though it's hit the Rev limiter or not boosting? Reason I ask is that if its doing the former it could possibly be an air leak, not uncommon apparently, or blockage in catalytic converter or DPF.
I know what the dealer has told you but I would want a 2nd opinion from a Mercedes specialist. Where are you located?

Our GL 320CDI suffered similar at 135k miles. Car went in to limp home mode and acceleration was sedate to say the least!
Traced to a sensor fitted to the unit that could not be replaced separately. New turbo fitted under MB warranty for free although it was priced at around £2,200 I seem to recall. That said, the main dealer we use did mention an MB official recon part being around the £600 mark I believe.
